Well I called the 800 misinformation number today because I finally got access to my ebenefits site. It showed my claims are all in the decision phase but 1 indicated that my "attention" was needed. So I called the 800 number and the lady stated that it showed all my claims were decided on and being reviewed for accuracy before notification. Im fairly certain after my piss poor C&P exams that Im going to have to appeal.

Question 1 is:

Do I immediately file a NOD or do I do this request for reconsideration first? Ive never heard of the reconsideration thing before browsing some of the other posts on this board.

If I do file the NOD right away, is it better to just go ahead and get a lawyer, or should I try and find a decent VSO? Ive tried using a VSO twice and ended up revoking the POA from both because they were totally worthless in doing anything other than submitting paperwork improperly.

Wait till you get your decision letters, redact personal info, and post them here.There are many members who will guide you through the next steps of the process. No need to spend money on a lawyer unless it becomes absolutely necessary.

You cannot file a NOD on something you don't have, same for a reconsideration. As for filing the NOD you need to slow down, you have a year to file the NOD. You never want to file immediately, you first need to read the SOC and from there you develope your claim. If you file the NOD quickly without developing the claim, you won't get nothing except another bad outcome. Listen to Tomahawk, get your SOC and then ask the Hadit members for guidance.

Bergie is correct. I know the feeling, as a matter of fact we all know the feeling. Just wait until you get your package. Go through. Also, look at 38 code of federal regulations. You might be able to find a couple of codes, they failed to use, that you can add in order to aid you in your case...

Well I was correct in my assumptions. They granted me 10% for my knee but denied everything else outright. Ill have to wait for my actual paperwork in the mail as they wouldnt fax me all of it just the notification letter. I just don't get how these doctors work. You would think that the doctors would want to benefit the vets instead of going at it with a deny deny deny attitude. I mean seriously when there is NO history of back injuries OUTSIDE of military, or not directly related to falling due to instability of service connected issues how is it "purely speculative" for the doctor to see a connection. And for a doctor to flat out state that NSAIDS don't cause or contribute to GERDs, and esophigitus is ridiculous to me.

Well at least Ill be getting the back pay on the 10% difference. Ill have to figure out what type of specialist I need to go see to make an IMO for my issues, and hopefully can afford it with the back pay.
