Question

Background - filed ptsd claim april 2009, denied nov 2009. Submitted reconsideration oct 2010 (based on new ptsd guidelines) and nod nov 2010 prior to my one year.The claim went to review in january, back to development 2 weeks ago for 'internal error'. Today I was informed that it is now being handled as an appeal and now under review w/dro and it'll be 1-3 more years!The VA has elected to disregard my reconsideration. Can they di that? What do you recomend I do at this point?

"Can they do that?" They did.

A DRO review can cause an award to be generated.

Or, you may end up going to the "Board" with the claim.

Since the VA is treating this as an appeal, it may be to your advantage to find a qualified lawyer.
