Recently I made a friend who is the grandson of a Veteran. Who is currently recieving benefits for disability. What exactly for Im not sure. However, he went on to tell me that his grand father had nightmares and wasnt sleeping and didnt like to talk about the war, and he could hardly speak anymore. He is 87 years old. And was shot in the back twice during deployment.

What I am asking is does he have a case possibly for ptsd? And would his wife be able to file a claim on his behalf due to his current state?

He is obviously a WWII veteran and should be receiving compensation from any residuals sustained from the Purple Heart wounds.

Also a GSW is an obvious stressor so that should not be an issue with VA to prove, as I assume his DD214 reflects the PHs as one PH and an Oak Leaf Cluster denoting the second PH.

But it is possible this veteran is already receiving comp already for these conditions, yet the amount might be way too low and he could re-open the claim,with current new medical evidence , if that is the case.

A veteran's claim is solely the veteran's claim until they become deceased and if a survivor's claim is filed.

Although spouses are a very big help to their veteran spouses in claims issues, the spouse should seek a service rep to help with filing the claim.I don't know what you mean as to his “current state.”

GSWs (gun shot wounds) almost always have ratable residuals.They are certainly a valid stressor, proven by proof of receipt of the PH.

If he is not being compensated already for these disabilities or the comp is too low, a vet rep would have no problem filing this type of claim for him.

If he dies during the long claims process, at that point the wife could be substituted as the claimant for any potential award of accrued benefits.
