Cue And Varo Response To Bva Decision

Not sure if I ask this question here or elsewhere, sorry if it is in the wrong location...How long does it typically take for the VARO's to receive the claim back from the BVA, and do they have a time limit to respond.. It has been just short of a month since the CUE was done by the BVA. How long does it take for the VARO to come up with numbers for my retro pay back to 69.. Seems like they should take care of this in a more timely manner?

That is a hard guess question.

I had a BVA remand in 2009 that only took a few months to award.

It then took me about 9-10 months to get my 'retro'.

But I was in an unusual situation.

The VA had never had a similar case.

The "retro" was the refund of my FTCA offset.

I had proven direct SC death after proving wrongful death under 1151/FTCA.

They ignored the regulations I sent them as evidence and I had to call the General Counsel, who ordered them to pay me.

The VA backlog has gotten much worse since then.

Do you use ebenefits to try to get any status?

recently the VA awarded my 2 pending CUE claims.

On one they said they didnt owe me any money , which would be correct, if they had done the initial CUE claim I filed first.

On the other, they awarded that CUE too but gave me a bogus reason they don't owe me any cash on that one.

I filed 4 CUEs on each of their initials denials =4 in March, and 4 on April the 6th I think it was.with the Director via email.

She tried to convince me by phone that the decision was correct and I found another CUE in it as we talked and I bust out laughing when I told her it was wrong.

She did apologize for the CUEs they made on the other claim.

They had even denied me the BOD rights I had.

I dont need apologys. VA case law itself says they owe me cash.

Yesterday I got a letter saying they are 'working on ' my main CUE claim..

In April of 2014 the 800 # said that claim was with a specialist for months until I found that was completely untrue.

Be grateful you dont deal with Buffalo RO. They cant read.

Hi Berta, No, I have not used e benefits yet...Sure hope this doesn't take month's, bet they will weasel out of paying what they owe, or they will start messing with my existing benefits.. Just wait and see I guess.. I must be a little impatient now...
