Yes and many of us here have done that many times....

You need to read the actual C & P results.

The VA withheld my probative evidence from C & P doctors in the past as well as recently but I fixed them on one claim, have another one still pending. They fixed that claim in a month or less.

If they denied due to a negative C & P exam, you need to go over every word of the denial, and the actual exam. They denied me long ago by manipulating what the doctor's exam ended with.When I found out from thedoctor by phone what he had actuallty said,

I fixed them on that too.

You need to determine if the evidence list in the denial excluded probative evidence.

Also you need to find out the credentials of the examiner.

I was remanded years ago by the BVA for a Cardio opinion.

I got a PA opinion. I knew more about cardio then he did.

I immediately wrote to the BVA that he was not a cardio doctor, ad they had ordered on remand and his opinion was too speculative. BVA agreed.

But I also had 3 IMOs for that claim too.

The VA had 2 against the claim and wanted one more to balance the scales I guess.

One of my IMos was only 2 sentences long.The other 2 were from Dr. Bash.

If you can scan and attach here the denial (coveder C file, name, address prior to scanning) we can help more.

Unfortunately these days many vets need to obtain independent medical opinions, which can be costly, to overcome deficient C & P exams.

What is wrong with that picture? EVERYTHING.

I have received some of the most riduiculous posthumous C & P s I can hardly belive. The veteran is dead so cannot speak for himself.

Thats OK...Medical Evidence is everything and often if it is a question of them not even considering probative evidence, those quack exams can be overcome.,when they are forced to read that evidence.

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.
