BVA APEAL THAT HAS BEEN REMANDED

Question

My  Husband was stationed @ Ma Cord Air Base , Tacoma Washington  1066--1970 he was exposed to JP-4 Fuel, Paint Strippers, Paint  Thinners, De greasers , while he was stationed there And he has been diagnosed with all of these by the VA DR's , He also went to a out side Medical Dr. that in his medical exam and after reviewing his medical records he noised him with all that i stated and even a couple more and said in his Medical Expedite that he felt more likely than not that and he stated each and every one separate that was more likely than the cause of the Chemicals he was exposed to while in the Military . The judge came back with that the Dr;s report had Good Merit but it more medical rationale .???? i thought that the law stated that a medical Dr only had to state after examination and review of his medical medical of more likely than not please advise !!!!!

Well, no.  The doctor has to give medical rationale as to why he offered said opinion.  You might be able to go back to the doc, and get this opinion.  

Its the old "double standard".  VA can get you a c and p exam, and that examiner can decide your condition isnt related to service, and he need not give a rationale.  

However, when YOU get an IMO/IME, it had better be precise, and have a good rationale.

Broncover is correct.

There is a lot more to a valid IMO than the key 'as likely as not " wording. It must comply with the main points here:

You mentioned in the profile request to me quite a few disabilities and many chemical exposures.

The IMO doctor would have to have expertise to opine on each of them and give a full rationale why they state 'it is as likely as not". 

Also they should rule out any possible other etiology.

Can you scan and attach the remand here (cover C file #, name, address) prior to scanning it.

Also can you scan and attach the IMO/IME as well?
