BVA appeal decision

Question

I finally after 6 years received a decision by BVA dc. It was sent to Portland for execution.  I was awarded TDIU for my 70%ptsd, denied for 100%ptsd, and remanded for lumbar strain. 

Now Portland wants to do a C&P for ptsd. 

The BVA said I should see the change to my rating and pay within 1 to 2 months. 

I'm at a lost why Portland regional wants a C&P. It seemed a closed deal. It's been almost 4 months now and no ratings change. 

Anyone got some help or something??

EPB:  What did your VSO say?  Did he/she look it up on VBMS?  What was the status on VBMS?  What did "ask Peggy" say?  How about ebenefits?  Ask IRIS email?  Finally, you can try writing VA a letter, on a 21-4138.  To reiterate, I would tell them the fast letter, linked above, dated in 2010 requires VA to promptly compensate Veterans for partial grants.  This would be a good thing to bring up if/when you call the white house hotline.  

Writing your congress person "may" be counter productive, but you can try that if all else fails.  

I guess this means you have NOT gotten your compensation, retro or otherwise, almost 4 months after the Board decision.  

Yes, waiting is always tough.  Especially when you need the money.  Vets advocates often recommend "getting a hobby" especially something that does not cost a lot of money.  A few examples of things to do while waiting, or pick your own.

1.  Go fishing.  You dont have to spend a bunch of money, my fishing license is free.  

2.  Play chess.  Yep, I do that.  

3.  Work on improving YOU.  Call people you have not called for a while, or write them. Go see them.  Tell your spouse you love them, and cook them dinner, and do 4 more things he/she likes.  Do something similar for other family members or friends.  

4. Read.  You learn a lot by reading. 

5.  Go to church.  You can also take college courses, including Bible classes.  

6.  Make a plan what to do with your retro.  That was fun for me.  

I divided it into 3 categories:

1.  Less than I thought.   2.  About the amount of retro I thought. 3.  More than I thought 

Then I put in numbers.  And, what I was gonna do with the money, all of which was give some, spend some, invest some.  

 

Don't have a vso, had one a long time ago told me there was nothing wrong with me.

The Va requested a new exam after I was awarded because it was from 2009 to 2013. Personally I believe they were doing the exam to reevaluate my condition as p/t status. I later won p/t that year. Since it’s been six years since your last exam they are probably required to do another one. I wouldn’t put too much sweat into it. Just be as calm as you can and describe all the symptoms of your best ability. Hang in there

You can get a new VSO.  Just ask for one with vbms access.  If you were unhappy with VFW VSO, for example, try DAV.  

Its not unusual for VSO's to give bad advice.  

I can understand him saying "there is nothing wrong with you", except that, "Where did he get his/her medical degree to get that diagnois?"  

Laypeople, including VSO''s or rating specialists are not compentent to make medical diagnosis, so ignore him and the 4 year old neighbor kid who thinks you are Superman.  

It was terrible for that VSO to do that.  So, send him packing.  Just sign up with another to get vbms access.   OR do without complete, upto date information.  Your choice.  

There is a wide variety of competence among VSO's.  From National VSO's, some of which could teach attorney's a thing or two, to newbies or burned out oldies, who are too lazy to do any paperwork and recommend you not file.  

I have had good luck with national VSO's which you can pretty much only reach by phone.  Mine are in Cleveland.  When you call a national vso, be prepared to take hours to get hold of him.  This is an improvement, sometimes, from local vso's, because, once they get your poa, they have a history of not returning calls ever.  Returning your call means he has work to do, and that is an interruption to drinking beer at the vfw hall.  So, the obvious choice is to just not return that Veterans call and buy another round.  

Its kind of like that everywhere.  Good employees.  Bad employees.  You never know which one you will get.  However, when you get a bad one, go back or call back another time, when you may well get a good one and ask for them every time when you do, so remember their name.  And treat them like they treated you or better.

Long have you been ratted? And did you request a increase?
