  1. They already admit it was done in connection with my already service connected hand claim. It was approved as secondary already to my hand claim and they admit all that. Now in the last paragraph they admit it was service connected but I didnt do the claim until feb 26? Is there some kind of time frame when filing claims? Thanks
  2. Just got denied again by the Regional Office supervisor on a NOD claim for 100% convalescent pay because the surgery was in Dec and I filed for secondary and was granted the claim in march? Say he cant go back and pay. Here is the results from the Atlanta Regional office..
  3. I had a surgery in 2014 I had a nerve release in my elbow because they said it would help my already service connected tendon repair in my hand/wrist. That happen on Dec 12 and I was home bound and away from work until Jan 17 in cast for left elbow surgery but at the time it was not service connected but i file the claim 2 months after surgery and it became secondary to my already sc claim of left hand tendon repair. The rater admitted that it was valid for 100% for the month of Dec-Jan, but he told me that because it was done before It was determined as secondary and awarded as secondary, I could not get paid 100% for that month because by law they could not go back and pay me. Does this sound about right. Even though the surgery was due to my already sc claim.
  4. I just noticed that on my C&P exam which lead to my reduction proposal from 40% for my left elbow to 10%, that the lady is a Physician assistant and not a MD Doctor. Will this help me on my hearing that's scheduled for my disagreement?
  5. Should I add DDD as a secondary to lumbar spine? Should I add Radicular bilateral as secondary to lumbar spine? or should I file as 2 new claims of DDD and bilateral Radicular.
  6. yes sir. I entered the army in 1991 I had a car accident while stationed in Germany in 1997. I had a p3 profile every since. No heavy lifting, no running, no wearing LBE gear, no carrying weapons or anything. I was discharged in 2000 for low back strain with a 10% rating. I just put in a few months ago for increase and got 20%. After x-rays this happen. Been on Percocet and flexaril from my va dr. and family physician.. Been seen several times for back pain.. They did a mri I think back in 2004
  7. This is what I got rated for after my C&P for increase on lumbar strain... A few days later I get these 2 letters from the nurse practitioner who did the c&p? Should I add DDD as a secondary? Should I add Radicular bilateral as secondary? Should I just leave the 20% rating alone and settle? I am very confused on this one.....
  8. So is 160 degrees on elbow extension good or bad.... I got 40% for 110 or more,, so how does that work..
  9. This is the C&p done by the Va. From this c&p they proposal to reduce from 40% to 10% for my sc dbd left elbow claim.. Its only been 1 year after they sc this dbd claim......

  11. That was my C&p for reduction. I had the 40% rating for 1 year then they sent me a letter for as they put it "an increase"!!! After my va c&p they sent me a proposal to reduce from 40% to 10%. I filed to have a hearing in Atlanta and they are in the process of scheduling a date for that hearing. Do you have the policy on that rating decrease to next lower level only?
  12. Va C&p ROM test results: Flexion: 25 to 115 Extension: 115 to 25 Forearm supination 0 to 85 Forearm pronation 0 to 80 She checked the box : Abnormal or outside normal range
  13. I already have a proposal from the Va to decrease my 40% for elbow DDD 10%. During my DBQ exam the Va doctor manipulated my elbow by physically pulling it toward her despite me screaming it hurts while doing the rom test with the gage, she had one hand on the gage and other hand pulling my arm after I stop moving it due to severe pain. My initial 40% rating is for rom extension with 110 degree's or more. I am just waiting on my hearing date. Thanks for your help
