Denied Fibromyalgia And Ibs

Question

I found out yesterday I was denied for fibromyalgia and ibs. I was in the gulf war 90-94. I put in a claim for presumptive. I had 2 dbqs filled out from specialist and all my medical records sent in. I called the ro to see why it was denied. First he said because there was nothing in my military records. I replied it is presumptive because I was in gulf war. He put me on hold. When he came back he told me the doctor who did the c+p linked it to another illness. I told him I saw the c+p and the doctor never mentioned that. She actually backed up my doctor diagnosis by finding all the tender points. He then said he would call me back. When he called back he told me there was nothing he could do because the claim closed. He told me to fill out a nod form and email it to him and he would expidite the appeal. He said he couldn't guarantee it would be approved but he would have someone else look at it. Does this sound fishy to anyone else?

I received my denial letter. It says

Irritable bowel syndrome

Explanation

Service connection for irritable bowel syndrome is denied since this condition neither occurred in nor was caused by service.

Fibromyalgia

There is no evidence to show a relationship between { } , which you had while in service, and your current { } condition. Therefore, service connection is denied.

I had a c+p Exam and see agreed with my specialist. She didn't give a opinion but I think that is the way it should be when it is presumptive.

Any chance you had a copy of that CnP exam? Because a GW CnP exam with no GW opinion is incomplete. It would have just a exam w/o an opinion. Now from what I saw from your rating decision not incurred in service not aggravated by service. That is a denial for direct service connection.

For direct SC you need a link to service, current diagnosis/treatment, and a direct service connection medical opinion to relate your current condition to service or Nexus.

Did your specialist add any type of opinion or did they just fill out a dbq and submit?

The way it should be? We're talking about the VA here Rude logic is out the window. Have you seen their calculation for SC %? I posted in your topic that had your attached RD. If it was me I'd resubmit and go to a GW exam.

This is not what they are asking for. That is the basic cut and paste. A few pages further back it gives more detail about why they did not grant benefits. That may help, us give you better advice.

If you have a current diagnosis, and you are a gulf war vet, then you need to send a NOD using something similar to the following links;

A lot of veterans are getting these types of decisions. I know it is hard but don't take it personal. VA is trying their best to cut down the backlog. The fastest way to do that is to deny a lot and I mean a lot of claims. A lot of veterans have been in your shoes, being denied for no real good cause. You have to do what you have to do. Channel your frustrations on winning your claim. Be upset but don't go into rage. I myself have been there several times and it will cause you to lose focus on winning your claim. Sorry for the bad news bud but it sounds like a normal day with VA and that really hurts a veteran and that is never good or acceptable.

Sorry to hear of your issues bud, as I have Crohns Disease. I have to totally agree with Pete's statements, but in the end I think that you will be fine. Me personally I do not like the Appeals or NOD process, just too long of a headache for me. I was denied multiple items in 2013 when I was retired from the Navy. Instead of NODs, I filed 4 FDCs in the last 2 years, with over 30 C&Ps and most were granted, even when I thought I had had enough with this whole VA Roller Coaster of Crap. Just sit down with someone who is knowledgeable and figure what is best for you and your family. Good Luck
