Dro Hearing
A few weeks back I posted that I was told via IRIS that my requested DRO hearing would be scheduled. Well, well, well, today in the mail I got a ity bity yellow envelop from VA. Inside was a letter, not a form letter mind you, telling me that the hearing would be conducted on the 16 of April with either the appeals team supervisor or the vet center service manager. It was a nice letter, was even signed in pen by the vet center service manager. It explained to me that even if I did have a SO (I don't), I could still attend the hearing alone as it would be such an informal format. It stated at least three times that the hearing was being conducted so that the VA could …

ptsd Help Did I Make An Error?
I was 40% since 2002. In Jan 06 I filed for Back condition, PTSD, Increased Knee and Depression. I jumped from 40% to 90%. Funny thing is, they rated me 50 % PTSD in November and finished up the partial claim in Jan 07. They finally found my dependency that was pending since April 06. I worked during 06, but it was really difficult. I was in a lot of pain and used all of my 2 wks of Vacation, 2 Weeks of PTO (Personal Time off/Holidays) for a total of 4. I also had to use FMLA for about a week time. When I could not take it any longer, I filed for I/U in March 1, 2007. Should I have claimed something from Jan 06, in which they retro'd my award. Please advise.

Emotionally Extremely Disturbed - Please Tell Me I Did Not Have Only 90 Days To File A Notice Of Intention To File Claim !
In New York State, if the medical malpractice / negligence occurred at a municipal hospital, such as one of the members of the New York City Health and Hospital Corporation or a County Hospital such as Nassau County Medical Center there are very strict periods much shorter in length. A Notice of Claim has to be filed with the municipality within 90 days of an event and a lawsuit must be started within one year and 90 days. At a hospital operated by the State of New York, such as Down state Medical Center in Brooklyn, Stonybrook University Hospital in Suffolk County or Upstate Medical Center in Syracuse a Notice of Intention to File Claim must be made within 90 days of the…

Owcp Schedule Award And Va
Got a friend who just got a schedule award (S/A)under owcp approved. He has not file a claim for the injury with the Va but can. He is a disable vet. This injury would be secondary. Should he wait for any certain time period before claiming the injury with the VA? Maybe 2008? Of course he is not going to try to hide the S/A from the VA but if they do not ask he might not volinteer the information. Any other concerns? Thanks

American Legion Poa
Berta I have been reading about your gripes With your poA for quite a while. At first they were totally FRENCE TO THIS HILLBILLY. The longer I read, the more I learn. I have recently been in the trenches with my American Legion POA. In my case I recently had a secretary making major decisions on what evidence should or should not be sent to the ro in support of my case. I to am very upset, and did not take it setting down. I took it all the way to the top. Ironiclly I ended up saving her , Her job. I am now being represented by the rep who's office is in the ro. Only today I was reading the AMERICAN LEGION POST SERVICE OFFICERS GUIDE 2006 EDITION. I am quite …

40% Tdrl 80% Va Rating
Hello all =) I was discharged 40% tdrl from the Navy in Nov06. I applied for a VA claim Apr06 and finally got back my final rating of 80% service connected. Dfas sent me a letter in Dec06 that my retirement rating is 100% and back payed me to Nov06. The dfas check is more then what the VA is going to send. So now im confused because I was told that the VA will recieve the 40% from the Navy until the "severence" amount is paid. Then I would get only a check from the VA. With the tdrl thing of 40% and seeing the dfas letter saying im 100%... maybe its the tdrl with the VA(40% +80%)? I thought the VA doesnt rate diagnosis that the Military rates you for? Am I o…

Help Getting An Increase
My husband had surgery during active duty on his ankle. He feel out of a tree during some training and broke all the tendons and ligaments in his right ankle. This was in 2001. In 2005 he applied for disability from the VA and got a rating of 10% in 2006. Since then it has been horrible just trying to get anything accomplished with them. He works so much that I've been left doing most of the leg work for him so that he doesn't have to take as much time off of work to do this (the VA takes almost half the day when he goes for an appointment). He wanted to get an increase in his rating to 20% because he feels that 10 just isn't enough. He had surgery in Sept 2001…

diabetes Visit To Pvt Md
I'm not sure if this is a relevant question here! At the request of my VA NP, I visited my local Dr,a week ago today, to update him on my DMII and the PN. He was pleased that I took the time to give him this info. We also talked about a continuing tremor evident in my hands and recent palpitations ( as I called them). He felt sure that the tremors were not Parkinsons. He had me hold my arms out, then touch each finger with the thumb of each hand and he remarked of some mild difficulty with this. In his notes that I obtained today he refers to "Dupuytren's contracture" in my rt hand. I looked this up on WebMD. I am interested in finding if this has anything to do with m…
