  1. The C&P was with ENT for my hearing. Got a call from my Congressman’s office my elbow claim is with the DRO for a decision according to their contact. Have to wait on the brown envelope to see.
  2. Recieved C&P letter from VA again this is the third for my elbow. How many can the VA request before they have to decide?
  3. Update received SSOC. VA has decided the continuous of service connection and requesting why I disagree with the rating. I sent an additional VA9, will wait and see.

  5. I agree, I have had claims since 1992 won 20% for DJD left ankle I represented myself. I had bad experiences with reps. I had to use a attorney for my left elbow fracture residuals that was at the USCFVA which was then sent back to the BVA and granted SC 02-07-2011 10% fractured elbow and 10% for cubital tunnel syndrome as secondary. I disagree with the CTS rating and now with the last VA examiner (who had to reference a medical book to know what CTS was) that gave his opinion the RO proposed to sever service connection, but my VA9 is very strong and pointed out what part of the law the RO failed to apply. But it is strange that no benefits has been reduced and the VA has forwarded my appeal to the BVA.
  6. The SOC doesnt state anything to support CUE, it states "It is proposed to sever service connection for cubital tunnell syndrome due to clear and unmistakable error. Thats it
  7. I am not the person on the report, the audiologist made a mistake either with my results or the person on the statement. I represent myself I don't have a VARO. The audiologist stated that I have Sensorineural hearing loss. But according to the reg. that is not considered as a impaired hearing. It would not be wise to invest in a IMO.
  8. Sorry for not responding in so long but I’ve been out of touch for a few months. The SOC 02-12-2012 stated proposed severance of service connection do to CUE. I sent a statement in support of claim after receiving this explaining what did not happen at the exam and the obvious qualifacations of thier examiner, my benefits have not been discontinued at the current rating, even the SOC stated This proposal will be final effective after a 60 day final notification period to you. I spoke with a rep at the 800 number in May she advised that my appeal had been forwarded to BVA but has not been assigned a docket number yet. I guess the RO had finally read the examiner's report. I'll wait and see what happens.
  9. My MOS was 63S20 Heavy Wheeled Vehicle Mechanic but I was with 1/9th 2nd ID in Korea 1st tour the 301st 7th Division at Ft Ord then 1/15 FA 2nd ID Camp Stanley Korea 2nd tour. Here is the last exam results by VA examiner. Word recognition scores were 98% at each ear. Right 250-10 500-10 1000-5 1500-10 2000-20 3000-25 4000-25 6000-15 8000-30 Left 250-10 500-15 1000-5 1500-10 2000-15 3000-30 4000-25 6000-75 8000-55 On the Addendum Statement: This Veteran would be considered to be employable only in a work position that required very little auditory-verbal communication. His word recognition scores for amplified spreech were 32% at the right ear and 42% at the left ear. This would indicate that even if amplification were worn, he would frequently mishear what has been said, even in a quiet work setting.
  10. Could someone please guide me in the right direction? I have a pending claim for SC hearing loss. I have been awarded tinnitus. The SOC states that my HL is not related to service due to a normal hearing test 6 mos prior to ETS. The Va examiner stated Right ear: pure tone test results revealed normal hearing through 6000Hz with mild sensori-neural hearing loss at 8000Hz. Left ear: pure tone test results revealed normal hearing through 2000Hz, a mild sensori-neural hearing loss at 3000Hz, normal hearing at 4000Hz, and severe sloping upward to moderately serve sensori-neural hearing loss above that. and opinioned that my HL was not due to military service based on a normal hearing test 6 mos prior to ETS. Should I pay 500 dollars for a IMO or what on the BVA?
  11. I disagreed with the award of 10% cubital tunnel syndrome. The Louisville RO scheduled a C&P exam with a doctor at Huntington WV. The examiner did not have any of my files at the time of the exam and speculated that I had an additional injury to my arm/elbow I told him I was lifting a box of paper and from that time on the symptoms was continues and not off and on. Nowhere in my medical records documented a second injury. The entire exam he kept referencing a book when he examined me for my cubital tunnel syndrome. I was under the impression he did not know what the condition was. The first C&P the VA’s examiner disagreed with my condition being service connected but on the exam the examiner referenced moderate symptoms and not mild as with several private doctors that did and an IMO from Dr. Jerry Bush. The BVA awarded service connection. Now the RO sent me a SOC and has proposed severance of service connection due to CUE. Do I have to prove again of service connection or appeal to the BVA this incompetent examiner’s theory?
