    I sent you another PM.

    Thanks again for the info. I finally know the differences about all the different claim areas. The second set of links, unless I missing something, which is quite possible, I knew all of that. Sooo I thought I would clear up what the va has from us and maybe someone can fill in the holes.

    The va has a medical document that states that he was in a Humvee accident From an explosion in the front. This was do ument is when my husband got back from Iraq and saw a doctor for his back problems at ft carson hospital.

    The va has a buddy letter, obviously not enough evidence.

    They have the va doctors request to the Tbi clinq. The Tbi cliniques evaluations for a year and a half. The specialist told my husband he has Tbi, treated him for tbi and issued him equiipment for Tbi.'so unless she wrote thiings in his records contradicting what she told my husband and myself. ( she was so sweet she would call me at home and ask how he was doing and if I felt he was making

    progress)

    They also have the nureolofical medical evaluation that they ordered for the claim. Rhe doctor there asked my husband if he would like a referral to rhe tbi clinic . My husband told him he was already a loyal

    Customer there.

    My husband sent a photo of the board they had in headquarters that mapped all

    But I feel like we are not just fighting about service connection, but if he even has Tbi at all. The cp examiner said it was not Tbi and it was emotional that was causing the problems.

    I don't know maybe I just made muddy water but I hOpe it might give a little more insitento this claim. Like I said if it is lost cause then I just would like to know zones can move on.

  2. As usuall I can't keep my mouth shut so I am sure I will get my head bit off, yet I never learn... So here we go, to say the fedral employees should get 10k while vets get 68k in my opinion is an over exaggeration. I mean they do work, they do have families to support and some of the same problems that most Americans have. Alot of them are vetrans themselves! (exlamation for emphasis not anger) ;) Those who are on 100% it should be enough to support a family on a tight budget. Those who are not, well it is just not suppost to support anyone 100%. It is ment to be a supplement because you just sent capable o holding a good job... So we go to mcdonalds, newspaper routes, and other low paying jobs to make up the difference. I think that if cuts are going to be made and people need to make a sacrifice financially it should be the wellfare. Those who can not pass a drug test, get nothing, and I could go on but I won't.

    So there we have it. I'm sure I was not real good at getting all the stuff I wanted to say out o my brain and into the words. So I am sorry.

    of the Rating Decision dated July 8, 2010.

    Leave out any names, addresses, claim #'s, etc...

    Decision

    3. Service connection for sleep apnea is denied.

    4. The previous denial of service connection for vertigo and dizziness with standing now claimed as secondary to residuals of traumatic brain injury (Tbi) is confirmed and continued.

    5. The previous denial of service connection for memory loss due to concussion now claimed as secondary to residuals of Tbi is confirmed and continues.

    Resons

    3. Service connection may be grated for a disease or injury from a service connected disability or was aggravated thereby. Service connection for sleep apnea on a secodary basis to this connection cannot be established. Your service treatment records do not show sleep apnea diagnosis. There is also no evidence showing sleep apnea was incurred in or aggravated by military service.

    4. Historically, rating decision dated 2/15/2007 denied service connection for a vertigo and dizziness and you were notified of this decision. The basis for that decision was no evidence that this condition had been clinically diagnosed. You are now claiming this condition as secondary to tbi.

    The claim for service connection for vertigo and dizziness with standing as secondary to residuals of Tbi is reconsidered. Service connection for tbi has not been established. Therefore service connection for vertigo and dizziness with standing as a secondary to residuals of RBI is not possible. The current va examinations explained the evidence does not show residuals of vertigo and dizziness and noted a pattern of tests was inconsistent with diffuse brain injury. Further, there is still no evidence that vertigo and dizziness with standing was incurred in or caused by service.

    The previous denial of service connection for vertigo and dizziness with standing now claimed as secondary to residuals of Tbi is confirmed and continued.

    5. Historically, rating decision dated 2/15/2007 denied service connection for ammemory loss and you were notified of this decision. The basis for the denial was no evidence that a memory loss condition had been clinically diagnosed. The current va examination shows you do not carry a cognitive residuals of Tbi. The current va examination dated 12/08/2009 revealed intact functioning in the majority of cognitive domains such as attention, working memory, processing speed, language, memory, and executive functioning. The examination stated that overall the pattern of tests is inconsistent with functioning. The examination stated that overall the pattern of tests is inconsistent with diffuse brain injury and any functional memory complaints are likely emotional in nature.

    Since service connection for Tbi has not been established, service connection for memory loss secondary to service connection Tbi is not possible. Therefore service connection for the previously denied condition of memory loss now claimed to secondary to residuals of Tbi is confirmed and continued.

  4. I put aside my husbands claim out of frustration to start my own. Now that mine is in the works I decided I needed to go back to my husbands. Good thing to, the last denial was dated July 8th 2010. We have done about 2 nod and been denied both times. Not service connected. I really don't know how to go about this... Another nod? Or cue? What to state in the letter? We are trying for Tbi. They say it is not service connected because he didn't go to the medics afterwards, so therefor it is not service connected. Even though he has medical evidence that states Tbi from explosion After he got back from Iraq. We also have one buddy letter. My husband was a sniper and squad leader in Ramadi and Faluja. Any advice is well appreciated.

  5. I have been told about 60-180 days. I have read different post. Some get in a month and others have been waiting longer then 180days. Bottom line who knows, but your close to the finish line! I just had my c&p may 9th. I am obviously still waiting. We are almost there! Hope your c&p goes well and you get it rated sooner rather then later.

  6. Why should you be different??? The rules apply to all. No offense, but you knew about the rules, or should have, when you entered the service and now you think they should change it, just because you think so. Why not work to get it changed, if you feel that strongly, instead of just b*tching about it. jmo - I do sorta agree about all the deadlines "we have" but the VA doesn't. The country is

    losing 18 a day to suicide . . . just think how much they've

    saved already!!! They have never cared about veterans

    and probably never will. Just keep up the good fight cuz

    Well here I go again about to put my foot in my mouth... ;) I'm going to assume you are talking to me. I have to say im

    not good at being very tactful, and this being all written not

    face to face i want uou to know i am not saying this with

    any malice. First off I don't get a gi bill so when I said me I

    ment veterans in general. I most certanitly do not

    remember any recruiter or paperwork saying what

    happens/deadlines about when you get out.

    Second as for doing something about it. I have written to

    my senator about the issues I have troubles accepting. And

    maybe when my four young children are grown and I am not so wrapped up in taking care of them I probably will

    step up and do more. Not my time and place right now. But

    maybe someone who cam and would beable to do more

    might act on my b-tching and complaining. Anyways for

    the record I think the va people in general do care, and are

    doing the best they can. But the system stinks and has no accountability. I will try to be more upbeat

    and positive. Im sorry for being a downer. But I was genuinely asking am I the only one

    bothered or idoes everyone have a better understanding

    of why the veterans benifits would be limited by time except for the fact that it makes it harder to prove that it is

    service related. We do have to many veterans dying and I

    just don't think deDlines on us help anyone. But I could be wrong. Like I said just asking.

  7. I can't help to much on the va part... I'm new to this all . But I can't help but draw conections with a friend I have. She had slot of the same problems you have. No doctors could figure it out. But by some mistake she happend to off load on to the right person. She was told to stop eating any kind of bread or pasta for a week. She felt so much better after that week. It turns out in her adulthood she has become highly allergic to gluten. ( I know it sounds crazy) apparently it would tear her up on the inside. And continue to do so even days and weeks after she eats the culprit. Her legs burned and she couldn't sleep because of the pain. Her husband was starting to think she was making it all up. Anyways I'm not saying you will have an easy fix like this but, it might be worth trying. Goodluck and I hope you receive the answers you ate looking for. The people here are awesome.
