  1. John 999, Sure hope that I didn't mess up your post. No, I checked and I actually did it right this time, don't know how I did it though? I shall try one more time to post and then if I do not succeed this time, I definitely have that GAF of 40 that those psychiatrist gave me. I have messed up more posting!! I lucked out and had a wonderful young doctor for my first C&P, don't believe that he had been around the block. I think that he felt sorry for me, for I was scared to death. I have gotten much smarter to the ways of the Va in the last 4 years. You are right all the Medical Centers are terrible! Josephine
  2. Nice to hear from you also. I have found the Salem Medical Center to be of not the best for C&P's. I am still fighting the Roanoke Office as they did not secure my medical records back in 1978. Hang in there and maybe we can help each other!! Josephine
  3. Kenny, Are you at the rating board at the regional office Roanoke, Virginia? This may help me, as all of my C&P's were also done at the Salem Medical Center. Josephine
  4. Hi Guys, If the Va was Not Seeking to deny me why did they do the following: 1. Send me for a C&P at their hospital by one of their doctors for an acquired psychiatric disorder and when they recieved a diagnosis of " Generalized Anxiety Disorder with a More than Likely than Not the Veterans Anxiety began in service, due to the fact that she was taking Librium for her nerves in 1964 and began treatment again in 1967 and has remained in treatment for the last 42 years. He also stated that I was unable to hold gainful employment since 1983 due to " Chronic Anxiety and High Stress". 2. The DRO did nothing with this examinaton, absolutely nothing!! 3. Within 5 months send me to the Board of Two and receive Axis 1 - " Anxiety Disorder not Otherwise Specified"; Axis 2. Borderline personlaity Disorder". Nothing Bother her in service, but explained no reasons why and how they came to their decision. What in the heck was I taking Librium and Caffergot in service for? 4. The R.O office is aware that one of the doctors refused to sign the C&P, but went ahead and rated it and refused to give me another C&P, even though, I wrote to them 18 times for another C&P. 5. Decision- We place our greater weight with the Board as they are a Board. Sorry that you did not like the C&P, but it was good enough for rating. I have 42 years of records for treatment of Chronic anxiety disorder. Dr. S. graduate of Harvard Medical School for 11 years. Dr. K 9 months and Dr. P for 28 years and all the records state the same thing - treatment for severe anxiety and chronic anxiety. I have taken about 10 difffernent anti-anxiety medication. The DRO should have adjudicated the first C&P, unless he didn't like the decision. This claim has been pending open since 1978. Thanks, Josephine

I know how to ask a question with New Topic, and I know how to Reply, but what is the secret of posting your comments to another members' posted Topic? Sorry if this doesn't make sense.   7. John, Thanks so much. I will see what I can do. My claim is a sensitive 6 and no one at the mangement center can ever open my claim. The toll free number at the Veterans Affairs will not work for me. I cannot have a representative in my home state of Virginia, as no one will be responsible for my file when it was in West Virginia I am constantly going in a circle. I went to the BVA and remanded to the appeals management center. The Va makes rules, but they break them all. I had a C&P examination with a diagnosis of generalized anxiety disorder with a more likely than not. The R. O office ignored that C&P and waited 5 months and sent me to the Board of Two They won out by giving me a personality disorder. I think that the R.O should have had to adjudicate the first C&P before they ordered another. I am totally confused in all this mess. Thanks so much, Josephine

  9. Hi there, Since my first C&P was a diagnosis of Generalized Anxiety Disorder with a more likely than not and unable to work since 1983. This C&P was Never adjudicated The second C&P by the Board of Two, 5 months after the first examination, was nothing bothered her in service with the Axis 1- Anxiety Not otherwise Specific and Axis 2 - Borderline Personality disorder. Only one doctor would sign the report the second doctor refused. The RO ruling - we will go with the board of two, because they are a Board. Thanks bunches!! Josephine
  10. Pete 53, No I am not getting SSD, never had enough points for that. I worked some here and there, but was never able to hold gainful employment after service. My hands have always had water running down my elbows to accomplish much. High Blood Pressure and Headaches and always living in fear. I took a lot of abuse in service. Verbal and Physical.   11. Patrick, I think that I understand what you are saying and asking me. I was diagnosed with my first C&P with generalized anxiety disorder with a more likely than not. He did not give me any Axis 2, 3, 4, or 5 - only unable to work because of high chronic anxiety since 1983. His examination was never adjudicated. 5 months later the board examination, the two psychiatrist placed an Axis 1 - Anxiety Disorder not otherwise specified with an Axis 2 of Borderline personality disorder. with the gaf of 40. My claim has been the most strangest thing that I have ever been involved with. I filed in 1978 and my case was never adjudicated. I filed again for same anxiety in 2002 and was denied immediately I received the pension in 2003. In 2004, I secured my psychiatric military records which were never viewed by the Va and turned in copies of these records to my local Regional Office. Immediately I received a letter from the DRO that stated that I had a personality disorder, but that this was not his final decision, as he was sending me for a C&P for an acquired psychiatric disorder. With the Statement of the Case, same envelope was a form 9 for me to fill out within 60 days. I filled it out immediately and turned it in. Next came the C&P with the diagnosis of generalized anxiety disorder with more than likely the anxiety began in service. 5 months later came the Reminder of my clinic appointment - C&P with the Board of two Psychiatrist. Axis 1 Anxiety disorder not otherwise specified. I didn't turn in any notice of disagreement to the R.O I contacted my treating physician in service, as I baby sit for him and his wife, sent him his records and those of the psychiatrist that he himself sent me to. I turned in my objections to the Medical Center, as the Board stated in theie C&P that I did not receive medical assistance for my early discharge. They stated the Command began my discharge, because of article 15's, which they stated that I denied. I denied the article 15's as I didn't have any. I turned in the letter to the R.O written by my treating physician and one to the hospital for the board to read. The board stated that Dr. C. did not give me librium for nerves or anxiety, but for a headache. Not true. the medication is written in my sick bay records the librium was for my nervous state and dispensed by Dr. C. I objected to the hospital of the hypnosis and there not allowing anyone to be present with me, my husband had ever right to be back there with the two of them. Only one doctor signed the C&P and the other one acknowledged, but refused to sign it. Yes, when doctor deliberately takes your private medical records and changes them to give you the personality that they want, this is fraud. I have a copy of my private records and yes, I have made sure that the BVA and The Management Center has seen what she, phychiatrist did to my records. You cannot deliberately change medical records. My medical records state Gravida 3 para 2, but she claims to have only two children. then no doctor is going to tell me that I have three live children. Gravida means conceived and para means alive. She has written Gravida 3 para 3. That is a bare face lie. She denies any self - inflicted injuries or eating disorder, so she says. That is a lie too and I can prove it. I am a severe diabetic, but that is the extent of it. She has written lies through out the complete examination. The slander goes on and on. I ask the R.O for another Examination, but when I received the denial, that is when they told me that I could not have another C&P examination. I will have to leave it up to the BVA and The Management Team to sort this mess. The doctor that didn't sign this report was a wise man. Thanks bunches!! Josephine
  12. Patrick, I agree with both of you. I am pleased that so many veterans are receving their benefits. I would have to say, yes, I feel that the Va. would definitely go out of their way to deny a valid claim. 1. I had a C&P in October 2003 and received a diagnosis of generalized anxiety disorder with a more likely than not that my anxiety began in service. 2. When does a Regional Office sent anyone to a Board of Two Psychaitrist within 5 months of the first C&P examination? 3. It is my understanding that only the BVA sends someone to a Baord. Please correct me if I am incorrect. 4. Why wasn't the first examination good enough for the Regional Office as their Va. Physician was more than qualified to give an opinion and made it with complete rationale of his decision. 5. Why would I receive in the mail a Reminder of my clinic appointment and then arrive to have a C&P examination, there was no mention of my having a C&P the day that I had it and the Regional Office vertified that I was going to check on treatment. 6. Why did the Board of Two Psychiatrist feel that they needed to use a light hypnosis for this examination, without my permisssion and refused to allow anyone to be present with me during their examination. 7. Why would the two physicans feel the need to falsify my medical records to give me a personality disorder and the Axis 1 that they gave me and I am certainly not a Gaf of 40 either, but perhaps under hypnosis, one may make a fool of themselves. 8. If you filed for benefits in 1978 and the claim was still open, as it was never adjudicated, this may give the Va. reason for the turn of events that happened. 9. Now the two phychiatrist have a chance to explain the rationale of their decision to The Management Center as remanded by the BVa. 10. They are going to have a chance to prove that all the lies that they said about me are not true. Thanks to you both, Josephine
  13. John999, Thanks for everyone's support. I believe that I understand, I am in a way dealing with two different diagnosis: 1. Generlized Anxiety Disorder 2. Anxiety Disorder Not Other Wise Specified. I looked up the not other wise specified, and the DSM manual mentions those who steal and murder and commit crimes. I guess that I just added something else to my character. The two psychiatrist have me as being a person of loose morals, denies any article 15's, behavior problem, and now a criminal. The good thing about the system, now they have a chance to prove it. It is all lies. Thanks bunches!! Josephine

  15. This claim of mine is over whelming me. I know everyone is tired of hearing about my claim. I just can't let them beat me out of my benefits. I had my first C&P with a diagnosis of Generalized anxiety disorder with a more likely than not. 5 Months later a Board of Two Psychaitrist - Axis 1 - Anxiety disorder not otherwise specified Decision- nothing bothered her in service. Paragrah before the decision - she was taking librium and caffergot in service. This to me is not a plausible statement. Why would I have been taking two coded drugs. What are they saying about me with the Not Otherwise Specified?? I could wring that DRO niece of mine by the neck for not helping me. I hope that she eventually makes it to the Appeals Court as she would like. Thanks, Josephine
  16. Patrick, What does Anxiety disorder not otherwise specific mean? What is the NOS saying? How can my niece be a supervisor of the DRO's and me be the dumbest one on the site? She just came to my home on the 17th of August to bring me a birthday cake and I have asked and asked her what some of this stuff means and she will tell me nothing. If she had signed off when I first filed again in 2002 and not waited until I had my first C&P examination, with a diagnosis anxiety disorder and more likely than not. This is when all the mess started. The minute she signed off, while I was waiting for an anwer, my file was being transferred to another state. Do nieces really have to sign off on your file? She said that she never saw it come past her. I can say that the VA is thicker than blood!!! Thanks, josephine
  17. John999, The personality disorder is what I have been working on. I just don't have one. All of my medical records starting with 1965 state anxiety disorder. I have other doctors that I went to and a private psychiatrist and now my doctor of 29 years. He is the one that wrote the nexus letter, as I have been to him for so long. He has stated that with 29 years of treatment of me that I do not have a personality disorder, only chronic anxiety disorder. I know that they did nothing with my claim of 1978, as they keep asking me for records. They only have that I filed a claim and nothing else. They didn't rate or even give the claim the time of day. I am hanging in with my military physician as he is was CEO of the Mayo Clinic, at the time he wrote the letter for me. He has since retired, but is ready to assist me in anyway that he can. He is just a wonderful honest person. He treated me in service and I babysat for him and his wife every weekend for his two children. I have kept his message on my answering machine all this time, as he states that I mailed him all of the military records for his review and he has reviewed them and to please give him a call. I should have contacted him earlier, but not sure that I knew his first name until I had the hypnotic C & P examination and exactly what state and city they lived in. I located him via the internet. That C&P was built on lies and one of the psychiatrist would not sign it. The doctors at the C&P examinations cannot figure out how to get rid of my profuse sweaty hands after meeting with death so many times in their old pool at boot camp and jumping off that old high dive into the water, knowing that I coudn't swim a lick. I can still hear them screaming at me and I dream of those old steps up to the high dive. I have lived the nightmare over and over since then. Thanks bunches! Josephine
  18. John 999, I have three letters by my pastor, to whom knew me before service and counseled me for years after service. He has written 3 letters to the Va and BVA. I also have a buddy letter by a women who was in service with me at each duty station. Boot camp to Washington, where I was discharged. I have not been able to find any information, as to why I went to a Board of two Psychiatrist after the first C&P. I think they were told to get rid of me. They tried, but have not suceeded. The Management Center has the option of sending me for another C&P if they deem it necessary. Nothing will change, for I am telling the story just as it happened. I am not sure if they can knock down the letter from my Military Treating Physician. I do know that they have ask him to withdraw his letter, but he will not, for it is my sick bay records that he dispensed the librium and the caffergot. They know that I am prepared to go the the Court of Appeals with this case. Thanks bunches!! Josephine
  19. I have asked so many questions concerning my claim for 100% Service Connected " Psychiatric Disorder". I was in the Navy for a little over a year and was referred by my military treating physician, Dr. C. to Dr. J Psychiatrist, to see if he had me on the correct treatment. I later saw another Psychaitrist who felt that discharge was best for me. Dr. C. was treating me with librium and caffergot for my nerves and headaches. I was lucky that I got to know my treating physician so well, as I baby sat for him and his wife. I was told constantly by the Lt. K., Administrative Officer, if I took the early discharge that I would be giving up all G. I Benefits. I believed this for many years. I filed for benefits in 1978 and was sent a letter that stated." You are not service connected". I assumed that it was because of what Lt. K told me as I took the early discharge. My DD 214 - 460 Emotional Instability I filed again in 2002 was sent a denial of benefits 2003 I was given a pension, no help to me due to excessive income of my husband. I went to the R.O and demanded to see my C- File, I asked the counselor where were the competency review reports from the Psychaitrist that I saw in service. He stated." There is nothing here." I wrote to The St. Louis Archives and received the reports by the different Psychiatist, to whom state that I do not have a Personality Disorder, just nerves, headaches and with a change of working conditons that I might be able to remain in service. This did not happen, the second psychiatirst recommended an early discharge. I turned in copies of the two Military Psychaitric reports and a letter by my Commanding Officer. I was immediately send for a C&P and was declared unable to work since 1983 and more likely than not my anxiety began in service. Diagnois Chronic Anxiety Disorder. My niece a DRO signed off on my claims file and I was transferred to another state. I waited for that office to rate me, but instead they sent me to a board of two psychaitrist. The two psychiatirst were very dishonest and falsified my medical records to give me a personality disorder and their use of hypnosis. When I left the hospital, as soon as my husband asked me about the examination, I knew that something was not right and ran back into the hospital and told a nurse that I couldn't remember a thing. She checked my blood pressure and sugar and they were fine. When we got to my daughers, My husband called the psychaitrist and he said that I would remember things in about 3 days and that he had told me to take a nap after the examination. Lucky for me that I didn't, for I remember now what went on in that room. The nurse called me the next day to see if I was feeling any better and I was not. They stated that service had no effect on me and that I did not go to Dr. C. my treating physician, in service to help me get an early discharge, due to the tremors, headaches and my nervous state. They stated that Dr. C gave me Librium for a headache, as well as the caffergot. Axis 1- Anxiety Disorder not other wise specified Axis 2 - Personality Disorder, Borderline Axis 3 - Rheumatic heart disease Transient Ischemic Attack Hypertension Hypothyroidism Inner Ear problem Diabetes Headaches Axis 1V -none AXis V - Gaf - 40 After 42 years, I called Dr. C. and sent him all of his medical records of me, and the reports of the psychiatrist, to whom he sent me to. Dr. C wrote me a letter that I had worked with him in service, that he did send me to the psychiatrist to see if he was treating me correctly. That I babysit for him and his wife and that he treated me with Librium for anxiety , as well as medicine for a headache . I have medical records of 42 years for treatment of anxiety disorder and no mention of personality. I have taken anti - anxiety medication since discharge. The R.O denied me benefits due to the two psychaitrist. Nothing bothered me in service. I went to the BVA and remanded in March. I have been in contact with the Management Center and have been told that the C&P by the Board of two Psychiatrist had been discounted, due to illegal means for an examination and changing of my records. If this true- I have the More Likely than Not C&P Letter by my Military Treating Physician stating that he treated me for anxiety 3 letters by my treating physician for the last 29 years, stating due to the fact that I took Librium in 1964 and again in 1967 and have been on anti-anxiety medication every day since, that service was the reason for my anxiety. He said that I did not have a Personaltiy Disorder and that they were patently incorrect. I have all of my private records from discharge to date. Had the Veterans Affairs had my Psychiatric Records when I filed in 1978 and the letter by my Commanding officer, I would have received a C&P and should have received benefits. If they had done more in 1978, and not have just a counselor decide my claim for me and sent me information of what they had, a statement of the case or anything, besides, you are not service connected. Anyway, I told the BVA I wanted 100% Service Connected Disability because they, the Veterans Affairs had violated my rights, by not securing those records in 1978, because they had been the archives for years. Sorry this one is so long. I am going to win, or die trying. Thanks, Josephine
  20. Berta, I turned in copies of the psychiatric records to the Regional Office in 2004 with a letter attached to each with the archive technician signature and the seal. No, I kept all the originals in a safe lock box. When the remand was sent to The Management Center in April 2006, they told them to check with the arhives to see if there were any other medical records never seen by the Va. The Management Center has told me for months that they placed a request to the St. Louis Archives to do a search and see if there were any other medical records. The archives sent me a letter stating that there were no more and that the VA had them all. That was fine and dandy, but they won't the archives to state that directly to them. The Management Center told me that the archives would be answering their request on the 2nd of September, but nothing has shown up. I checked with the archives and they state that The AMC has never turned in a request for any medical records. I turned around and sent a letter to the archives today by internet to sent a fax directly from the archives to the AMC stating to them that there are no more medical records. The BVA and The AMC cannot understand how I was able to secure my psychiatric records after 42 years from the archives and why the RO had never requested the records. Even though my niece is a DRO at my closest RO, my file is not there because of her, I have learned that the VA will lie about anything and that does include my niece.   21. The Management Center in Washington D. C. has told me over the telephone that they were expecting any old medical records of mine to be in their office the week of the 2nd of September. I called yesterday and one of the counselors told me that she hoped that they were faxed to them this week. The BVA has ask for a search for old medical records to see if there are any out there that are not in my file. This would be because in 2004, I turned in all of my psychiatric records and a letter from my commanding officer, to which the VA had never seen. I filed my first claim in 1978 and the only reply of decision was a letter that stated " you are not service connected." I did not receive any statement of the case or any other papers. When I refiled in 2002, they still did not get these records and now The BVA wants a search to make sure that they are not others out there, that they may have not secured. I contacted the St. Louis Archives yesterday and was told that The Management Center had not requested any medical records or anything on me. Is there anywhere else that old records may be stored? Now, I don't know whether to believe The Management Center, that they are due in the 2nd. Is it possible that they typed on my VCAA notice that they had sent for them and did not do it. Terry, By the frown on the smiley face, I think that you are saying that I have lost 42 years of backpay money, as they did not adjudicate my first claim in 1978 and just sent me a letter stating not service connected. No medical records and then I locate them in 2004 and perhaps may win some of my money. Thanks, Josephine
