  2. Hello, I have an appeal that was decided April 5 by the BVA. The appeal was granted in my favor.....an increase from 50 to 70% by the BVA. I have not heard much from the regional office so I sent an inquiry and recieved this email today: Your appeal is currently in the final stages of processing. A rating decision was made on July 8, 2013, and your appeal is now waiting for final review. Once the decision has been reviewed and processed in our system, we will notify you by mail. I am confused as to why they would have to make another rating decision because the BVA already made one in the letter it read: An initial rating of 70% is allowed. Does this mean from the time I filed? Also does anyone know what rating decision the regional office makes on BVA appeals? Thank you
  3. Tks 4 answering! Im not sure what is going on each time there is a different answer when I went to talk to someone. I have to deal with the Atlanta RO and they are a complete mess! I applied for TDIU in 2009 but did not submit my form 9 when they denied me. They said my schedular rating wasn't enough at 50% so I was denied. Im hoping that now since BVA put me to 70% they will consider it but I'm not counting on that I would be grateful to recieve the retro for the claim that has already been granted.
  4. I was granted an increase from 50% to 70% by the BVA. I recieved the letter from the BVA April 5. I went to the Atlanta RO a couple of times and each time someone told me they were "working" on my file. Then I went back to see if any progress had been made and today someone told me that there is a 90 day wait on files that come from the BVA because they are locked for 90 days. If this is the case why didn't they tell me this from the very beginning and why are the files locked down for 90 days?!!! This doesn't make any sense to me and he also said I could put in a hardship to see if they would process it sooner?..... Im just confused I read that all decisons from the BVA are suppose to be processed immediately. Has anyone else heard of this 90 day thing? If so is there any way to get my claim processed sooner? I put in a hardship but I'm not sure that will help.
  5. Tks for responding! I read that the VA is allowed a certain amount of time to process claims granted from the BVA. Is this not the case? Can the VA take as long as they want to process an award granted by BVA?
  6. Hello, I am new to this website so I hope I am posting this correctly. I have a question about an appeal that I filed in 2008. I am service-connected at 50% for MDD. I filed an appeal for an increase in 2008 a few months after I recieved the decision letter. The appeal is for an increase and in the letter the BVA stated that 70% is allowed for the initial rating. I also filed TDIU in 2009 and was denied. The letter stated I was denied because I did not meet the schedular requirements for TDIU. My question is if my rating increase will they consider the TDIU now and is it likely to be granted? Also, I have not heard anything from the VA regional office about the BVA decision which is dated Apr 5 13. I spoke with someone at the regional office and they said it is being worked on. Does anyone know how long this process will take in regards to receiving a letter from them or any information? I would appreciate any info! Tks
