  1. I'd like to take this opportunity to Thank each of you for your thoughtful advice; I have decided too much of my time and energy has been spent or wasted on worrying about this claim. The law firm that had represented me has been compensated by the U S Court of Veterans appeals; please see previous post (13 Mar 2014), they worked with the United States Court of Veterans appeals to have my case Remanded back to the BVA but their (the Law firm's) assistance, communication and or help ended as soon as they were paid by the U.S. Court of Appeals through the Equal Access to justice Act. I have not received any compensation or a determination on my case; all I'm trying to find out is where its at in the claims process and if there is anything I can do to assure it is decided fairly. I will try those Phone #'s you gave me and will hopefully find someone willing to listen and help; Thank You for your continued support and advice and I apologize for any confusion I may have caused. I have contacted two law firms recommended by this website they both said since my claim was in the appeal process; they would have to wait until it was denied by VA before they could even look at my file and that since claim was in appeal status I could not elect to revoke my current POA/DAV until a decision is reached by the VA. Their advice was to wait and see what the VA decides and go from there. I tried to explain this current appeal has taken several years and I still have no answers but they could only recommend to wait on the VA's decision. Seems as though I'm being boxed in but I still solicit advice from anyone who may have experience or suggestions; Thanks as always! Dan
  4. I will remain hopeful that each of you will get the justice and settlement you deserve. I'm a bit behind the power curve on trying to followup on an appealed claim. Tried the 1-800-827-1000 just given "Bull" and asked to be patient and wait, same thing from my DAV rep, tried contacting Office of Case Mmgt 202# but they have not responded, my file is at the Regional Office but cannot get anyone to tell me where its at in the claims review process. I can relate to the frustration but not sure where to turn, could you shed some light about who or what the iris is, could they possibly get/give any more details about my claim?   5. Hello Bob K, I have the case Mgmt Ph # you suggested will call in the a.m.; also have been doing a ton of belated very useful research on this website. I can see I've made quite a few tactical errors; mostly in believing that my claim was in good hands and being aggressively worked. I would also solicit advice on how to find another more reliable, caring and knowledgeable DAV representative, or suitable substitute. What is the process to fire (for lack of a better word) my current DAV rep and then appoint someone else? I would really like my claim to be handled by an entirely different office as I believe this one is either overburdened, unsympathetic or a combination of both.   8. I'm back again Berta, The law firm that represented me out of Rhode Island was compensated for their services. They filed a petition for fees with the US Court of Appeals for Veterans Claims under the Equal Access to Justice Act (EAJA). The Court ordered the VA to pay the fee to the law firm for their services in representing me as a veteran. On 4/15/2013 the the United States Court of Appeals for Veterans Claims found in my favor that the BVA had committed legal error; my case was sent back to them with instruction to correct the error. I don't believe they gave (the BVA) any deadline or consequences for taking too long in arriving at a decision and can offer no other explanation or details. I was instructed to contact my local DAV for assistance and their standard reply is and has always been the same " We haven't reviewed your file but our advice to you is just be patient and wait another year or so these things take time" I am a patient man but would like to know more of the process and if there is anything I can do to speed it along. Hello Berta, Thank you for your comments and questions and to me it does not matter that your civilian I welcome any and all advice; you've asked several questions and I will attempt to answer them briefly Total SC 80 Seizure Disorder with Neurocognitive defects 60% Hypertension 10% Gastroesophageal Reflux disease 10% Hypothyroidism 10% Rt Shoulder Bursitis 10% Rt Ankle Tendinitis 10% Where I went to school these numbers would add up to more than 80% but the VA must use a special kind of calculator. I have reactive Hypoglycemia but have never been diagnosed with any type diabetes although they test me for it each year. This answers a few of your questions and I'll address the others later to maintain brevity and minimize confusion. Thanks again for your advice! May God Bless You. Dan
  10. Medical eval is tomorrow, had the EMG done in 2007, results did not indicate lack of nerve signal; I suffer from hypersensitivity, constant pain tingling and burning of both feet. Will adamantly restate my symptoms and related medical conditions to VA Doc at Fayetteville Ar. I currently have a service connected disability rating of 80 but the foot/feet condition is getting progressively worse. I am out of work and options but retain some small hope/belief (based on some of the stories I've read) that things will work out. I served in the AF from 1982-2004 and upon discharge several VA docs could not make a definitive diagnosis, one time they would call it Plantar Fasciitis then decide it was peripheral neuropathy but always the burden of proof fell upon me to prove. Frustrated I gave up after several years and was then contacted by a law firm in Rhode Island who said they work for Veterans felt I had a case and would take my case for free and settle with the VA if they won, they did and were compensated by the VA last year but the VA continues to drag their feet and are now sending me for re-evaluation for a condition of flatfoot which I've never complained of and know nothing about. My AFSC 42353 Fuel systems exposed me to multiple chemicals linked to causing peripheral neuropathy; mainly Jet fuel JP-4 & JP-8. There is documentation in my my medical records which proves I was exposed to and treated for overexposure to Jet fuel such as chemical burns and fuel saturation of feet etc... I do not have the funds to retain an attorney and don't quite know where to start all over.   13. 22 Yr USAF Veteran, AFSC 42353,Fuel Systems Mech,; I have an ongoing disability claim for peripheral neuropathy, symptoms are getting worse but cannot get an accurate diagnosis from the VA has been over 9 years of appeals etc... would appreciate any advise on how to proceed.
