  1. I keep excellent care of my VA records but for some reason, I cannot find the last denial dated April 2013. Can I get VA Regional to forward me an expedited copy? I apologize, I am not feeling very well today. Yes, I am claiming that the VA made my conditions worse and I was unaware that I could file a 1151 claim. A tort might be too late in terms of statute of limitations. I will go through my paperwork today and explain later or tomorrow. Thus far, I am amazed with what you have offered in terms of options with what little I have presented.
  2. Yes, I had an exam on 25 Jan 2013 and was turned down because they said my service connected disabilities got worse because I worked for 20 years sitting which made my back worse. But I didn't work for 20 years and never said I did. I worked full-time for 18 months from 1997-1999 then I had 4 major back surgeries in May 2000, June 2003, March 2006 by the VA in Manhattan and the last one Aug 2009. I attended the VA Pain Clinic all this time during which time I had regular labs, X-Rays and MRIs. Since I finally won Social Security Disability in 2009 I saw a local physician because the VA is an hour away. From about 2004, I noticed consistent elevation in my alkaline phosphatase and Calcium in my labs and asked about it. No answer so I looked it up. The chances were very high it was Hyperparathyroidism which will destroy your bones among other things. So I asked my local doctor to order a Parathyroid lab. and it was very high. I had a tumor on my parathyroid and it was removed in July 2010. I talked to the the Comp & Pen physician at length about it because of the terrible effects it has on the body especially your bones. My alk phos and calcium levels increased again in 2013 and so I had to have another tumor removed. Unfortunately, I now have Hyypoparathyroidism and only just found a great endocrinologist locally. He prescribed Calcitrol and told me it was very rare. Prior to that, the doctors were doing Nothing. So to recap, I applied for 100% for unemployability was denied in 2013 because they said I had worked for 20 years and that was why I was doing so badly. I actually worked full time for 18 months from 1997-99 and then worked weekends until 2001 because I started having major back surgeries. I turned 57 in December. Secondly, I had been receiving terrible care which made my condition worse which I only just discovered. I have a Comp & Pen exam on 27 Feb 2015. I went on to myhealthevet website and printed off my labs and radiology. I hope I have cleared things up. Thank you for taking the time to read my questions. Kindest Regards
  3. I sent in a Notice of Disagreement Dec 2013. Since I hadn't heard anything I sent another letter 21 Jan 2015. I received a phone call about one week later setting me up for a Comp and Pen exam on the 27th of Feb. I was alright with that until I started reading about Fully Developed Claim and a Veterans Service Officer. This hasn't been mentioned and I am wondering really what does it mean and would it be useful to me? My concerns stem from the last examination as the denial was based upon a completely erroneous claim that I had worked as a New Researcher for the past 20 years and that was the cause of my problems. I had worked as a News Researcher full time from 1997-1999, 18 months in total and then I worked weekends until my health crapped out in 2001. Needless to say, I am a bit nervous and obviously apprehensive and quite mistrustful. Can someone help me because I truly feel I'm being railroaded and not being helped by the VA as I should be. Thank you
  4. Hi - I am presently at 60% After sending in a Notice of Disagreement in Dec 2013 and not hearing anything, I decided to forward a letter requesting movement on my case. I received an immediate phonecall. First of all, my last appeal for 100% for unemployability. My last comp exam was in 2010 and I was turned down because they said I probably ruined my back by sitting and working as a researcher for 20 years. Mind you, I did work as a News Researcher for 18 months but had to stop because of the problems stemming from my service connection conditions. I am still rather stunned as to where they acquired that information being that I have not worked since 2001. Back to my question: I had an EMG in 2012 which I requested myself using outside physicians for my own use to assist my treatment. The VA wants to do another EMG and if anyone has had one, you might understand my crankiness. Can I not submit the 2012 report for comp and pen? My newest endocrinologist doctor, who saved my life recently said to me "It looks like the VA was trying to kill you". I discovered on my own research that I had Hyperparathyroidism and it was evident in all my labs that the VA had for so many years. I finally decided to research the high calcium and high alkaline phosphastase and asked for a Parathyroid test. I had a tumor removed. It recurred in 2013 and had another one removed which gave me Hypoparathyroidism. My doctor could not understand why so many doctors refused to even check to see what it could be. Needless to say, I'm tired and cranky. So second question, can VA malpractice be brought into Unemployability compensation? Thank you all. I apologize for the meandering but it's been a long road. Sometimes it's difficult to stay on course regarding this subject.
