  1. Hopefully I will be there with you soon. I am at 70% and my current claim just went to Prep for Decision phase.

    From reading my C&P results and what the MO's stated with the evidence, I should hit the 91% mark rounded down to 90%. Then should get at least 1 month at temp 100% for post surgery.

  2. The biggest question is when did you add your kids and wife to your claim for VA disability? That will determine when they would start paying you I would think. If the VA had the dependent claim and paperwork to verify the members back in 1990, then it seems you would be good all the way back to then.

    After reading your post, your wife may be included in the CUE claim. If she was added during your re-open claim and that is what you called CUE on, then check to see if your pay is with wife only.

  3. My VSO rep sent in my signed form for the Temp convalescence pay the day after surgery. How does this work? I was given 18 no work status, then 6 weeks very limited duty status from the day I returned to work, then was told that complete recovery would probably be about 6 months or so. How do they determine the convalescence pay timeframe?

  4. 1st, I have a current claim for disability with about 22 contentions (new/secondary, or increases). Some of these contentions are for my shoulder that I just had surgery done on the 9th, the C&P is on the 28th. Will that affect the exam? Or will they wait?

    Also, my current disability claim has been in since November 2014, I just submitted a CUE claim at the end of March 2015. Is there a possibility that the CUE and disability claims will be worked together and awarded at the same time?

  5. was wondering how this works after surgery? I had shoulder surgery last week and the doctor gave me no work duty for about 3 weeks, then it states that the following 6 weeks is desk only, no lifting, field work, etc. Then after that, it states it will be subject to follow up appointments. I was told by the doctor that full recovery would be about 6 months or so. Just not sure, what part of the limited/no duty/light duty plays into convalescence.

  6. what are you wanting to do? the VA seems to have S/C'ed you at 0% back in 1998 and then increased you to 10% in 2014. also, if you are looking for a 10% rating in 1998, was tinnitus even rated above 0% back then? I remember seeing somewhere that tinnitus used to be a 0% rating.

    If you have the documentation and it supports a 10% rating in 1998 and believe the VA's CUE is wrong, fight it.

  7. I just viewed my current claim status and it has the following under needed from you:

    RVSR review for VAE

    It also has a needed from others request, nothing showing there.

    Could this be because I submitted a CUE claim last week or for my current claim? My current claim has been open since November 2014 and I haven't had any C&P's for it yet.

  8. The VA did my sleep study (at home and in person) through the local hospital since I live about 110 miles from the VAMC. They paid for it since it was a PCP diagnosis while I was only at 20% S/C. When the study came back through the VA sleep clinic as needing a CPAP and was moderate/sever OSA, they issued me a CPAP through Norco local office. I finally asked my PCP is she thought my OSA was associated with my hypothyroidism and high blood pressure and she wrote me a letter stating so. Sent that in as a claim for secondary OSA to hypothyroidism and it was approved within 2 months, no C&P required.

  9. I had a sleep study done a few years ago with the VA. My symptoms were: obese, snoring, large neck, have hypothyroidism, wife stated I stopped breathing at night sometimes.

    Study came back as Moderate OSA (I was having 29 episodes a minute) and 30 is severe. They issued me a CPAP machine to use. I use the machine about 4-6 hours a day and still wake up with fatigue, sleepiness through out the day and like to doze off for a few minutes in early evenings.

    Do you have a copy of the actual sleep report? Mine at the end stated a diagnosis of Moderate OSA and recommended use of CPAP for treatment.

    Somewhere in your report near the end, it should state what the diagnosis was.

    Good luck with the process. If you feel cheated, get a second opinion.

  10. Had a C&P for an increase to my thyroid issue. Doctor wrote this at the end and to me sends a 50/50 chance. I also had a family doctor letter sent in for this issue.

    In my opinion, none of the claimed symptoms of hypothyroidism are solely attributable to the veteran's thyroid condition. Careful review of his complaint of weight gain does not show any evidence that his weight is particularly sensitive to hormone replacement levels and in fact despite over replacement over the last 6 months his weight has increased which argues against his hypothyroid condition being the sole etiology of his weight gain. His other complaints are very nonspecific and not particularly highly suspicious of a chronic hypothyroid state.

    What does anyone think about this statement the doctor wrote?

  11. Received my decision letter in the mail. They approved me for 10% for recurrent tinnitus established as directly related to military service. Part of the evidence that was listed on this decision letter was the Rating Decision, and all evidence contained therein dated August 31, 2012. This was the original denial letter.

    So my question is: Should I file a NOD requesting an EED due to the same medical information being used to decide the new claim that wasn't looked at in 2012? Or should I file a CUE and use the VA training letter 10-02 as the mistake (the VA should have given me S/C without a C&P due to it being in my STR)?

    Thanks for all the help and information. The reason to fight this is about 7000.00 in back pay because this would have put me over 70% back in Sept. 2012.

  12. Gastone - thanks. I did submit what I thought was new and material and missing from the original C&P exam. The RO also added my new claim items for my hashimoto's thyroiditis and Goiter to my appeal. Just had the C&P exam this past Monday, so we will see. I feel with the information that the Doctor added to the C&P DBQ that was missing in the 1st one, I hope to get the increase. My problem is with the increase for hypothyroidism, I only have 2 of the 3 symptoms for 30%, 1 of the 3 symptoms for 60% and 3 of the 6 symptoms for 100%. I know you can get an increase for having some of the symptoms, I just hope they see it that way too. I am waiting on the C&P exam notes to post to see what was said.

  13. Good morning,

    Was wanting some help with potentially filing a claim for anxiety. I saw my doctor in December because I was reading an article about depression in men. I identified at least 5 of the 12 symptoms of depression that I have. Doctor stated she believed I suffered from anxiety related to my S/C medical issues causing it rather than depression.

    Should I file a claim for Anxiety secondary to my S/C disabilities since that is how she stated it?

    Any help would be great.

  14. Seems like what I am in now. Was denied S/C for tinnitus and hearing loss. VA sent me to a private audiologist for the exam. Doctor stated that I never had tinnitus or hearing loss in service. Didn't know better at the time, let the claim close after the appeal period. In 2014, filed a re-open claim for tinnitus and H/L. VA sent me to a VA doctor and he stated it should be S/C for both. Also had a private NEXUS letter that backed up the VA doctor. Waiting now.

    I was told to wait and see what the new decision was before filing a CUE. The reason I possibly may file a CUE is the VA didn't follow their own Training Letter 10-02 on my 1st claim. I have evidence in my STR that I had tinnitus and hearing loss.
