  1. I went to little Rock today and talked with my rep, we are requesting audit on my file and the dates, we will see what happens. Thanks for all the help, and I know what you are saying Berta, I have fought with them for 4 years over my clams up to 70% now, I have 2 clams at the rater now, waiting to see what happens with them. Carlie they were both a NOD,service connection was granted on both the first time, but they both got closed by the VA when the VA rep called me and we had a few words about the way he talked to me on the phone, They got opened again, but that might be the problem who know.   4. John the date I was fist got the service connection for IBS and the Hemorrhoids was 6/27/2007, the date the claim for both was started was in march of 2007. The Decision sent to me says (The evaluation of constipation( also the claimed as IBS) is increased to 30 % disabling effective June 12 2008, the date you were seen for increased symptoms, including loss of weight). This was a NOD, but I was payed from Sept of 2008. The hemorrhoids,Decision says The evaluation of hemorrhoids is increased to 10 percent effective Jan 22 2008, the date you were seen at the VAMC for increased symptoms. I hope this will answer your question. They are both secondary to my Back injury. Thanks Ken

I have a ? about Back pay on a claim, I filed a clam on September of 2007 IBS and Hemorrhoids secondary to my back, I am not getting payed for the date on the clam but for the date sent the new information from my doctor, just wondering if this is the right way it should be done? I also have a big problem with the VA in little rock, my local va office and I called and ask, if the pay date was right on the claim, we looked at some of the date on my clams and they are not the same as the ones they gave me on the decision on my clam.I am going to the VA office in little Rock to find out what is going on, they lost my file when i pissed on one of them on the phone, i called a month later and all my claims had been closed. I went to Little Rock and talked with them and they got opened again, but dates are all messed up which messed up the date, unless it was done on purpose, I hope not. Thank Ken

I would like to thank everybody for all the help they gave me, about the the question i had about my ankles, I called the hospital and talked with the patient advocate and she talked with the doctor and I got a second opinion, the new doc said that my ankles are really bad and needed to be repaired, and I am being sent to little rock ar,I have had surgery there before and had no problems with it. I thank the first doctor got in a little trouble for telling me the VA would not pay for my surgery, again I wanted to thank everybody for the help. Thanks Ken

I have a question, I was at the VA today to see the doctor about my ankles, I had a MRI on both of them and it came back that anterior talofiblar ligament in both ankles was not visualized and likely chronically torn, along with distal Achilles tendinosis in my left ankle and and a bone spur at the Achilles tendon insertion on the right ankle, there is allso a lot of other small things wrong with the ankle. The question is the doctor told me there was nothing he could do for me, there is a surgery to fix both ankles, but he told me he did not think the VA would pay for it, he said it the kind of surgery a pro basketball player would get, the problem is I am service connected for both ankles because of chronic sprains to the ankles, it seems to me the VA should pay for it, it was done in the military. I just wanted to know who I should talk to about this, to see if they will fix it or not. Thanks Ken
  10. I did put my appeals in writing through the Veterans rep and i guess i pissed them off and they canceled them all and thats why i'am going in person to talk to them to get it fixed. Thanks for the replies. Ken

Has anyone ever had this happen, I talked to a V.A. counselor a clam on a bilateral on my ankles and he told me I all ready had the bilateral, which i did not have and I told him that and again he said I did, he told me I had it and he would close the clam on my ankles, at which I told him if I had the bilateral, he could close the clam. about a week later I got a letter from the V.A. saying I said they could close the clam and I did not want he bilateral which was wrong. i call the V.A. counselor and told them what had happened and she said there was nothing she could do, so I told her I was going to call my congressmen at which time she said she could reopen the clam, clam was never reopened. I called V.A. counselor and they told me I had no clam on file I have 5, I called the American legion my rep, and he said my clams had been canceled and are not open at this time all though 3 week ago I got a appeal letter asking for more info on my clam. I have to go to little rock and talk to the V.A. counselor in the morning, in person and find out what is going on, just thought I would ask I anyone had any problems like this. THANKS KEN

  13. I have a questions about Plantar Fasciitis, I have it in both of my feet. I am service connected for for DDD in my back and limited motion in both ankles and bone spurs in my heels, which I feel might of helped cause the Plantar Fasciitis. The question is how does the VA rate Plantar Fasciitis and could someone tell me where to find the information on the rating. Thanks KEN

  15. I have a ? about the Achilles tendon, is the Achilles tendon for rating purposes, a part of the ankle, foot or the leg? I need to know for a secondary clam where the bone spurs on my heels rub on my Achilles tendon causing a lot of pain and makes it hard to walk at times, on my right and left heels. I am service contected on both ankles at this time. Also if any one can tell me about a secondary clam on IBS for the medication I take for a service connected back problem, the medication causes the IBS. Thanks Ken
  16. Thanks for the advise about the ankle, I am service connected on both of ankles and am trying to get bilateral on them right now. I am going to NOD the ankle rating for now if it does not come back the way I want it I Will appeal it, my doctor just prescribed orthopedic shoes for my work and normal day to day walking.   19. I am 20% for my back and 10% for each ankle a total of 40%, the 20% is for limited motion in back got no % for incapacitating episodes. I will appeal or NOD both. I understand you are not noise good luck with the back clam. Thanks KEN

I hurt my back in the air force 1993, I was a M-60 gunner and our ops officer took away my assistant gunner which made me Carrie the gun the ammo 2 cans, the spare barrel and all protective gear, after that I hurt it a couple of other time while in the air force(The ops officer got in a little trouble and the assistant gunner was added backto help the M-60 gunner). I hurt it again in 2000, just got out of bead and could not walk,jury of 2006 was the last time I hurt it and that is were i am now. The percentage part you get percentage points for the time you are on bed rest incapacitating episodes. Thanks for the help I am going try and do what you all said, going to the VA to day for a doctors visit I will ask him about it all and get my records i do not have. I am 40 percent for back a left and right ankle another story, on my right ankle I broke it in the air force and did not know it until a year, when I broke it they said I sprung it the next year when sprung it the doctor told me i had broke it before and it held up a little off and sent me to get a MRI in england and it showed a fracture and the VA says i never broke or fractured my ankle and i sent them the report 3 time and still say the same thing but I do have limited motion, hill spurs and Achilles tendon problems because it rubs on the bone spurs, i will appeal this one.   21. I Have ?, I hurt my back and went to the ER to have it checked out and they told me to keep off my back and rest and if it was not better to see my doctor, that is were the problem started. I called my doctor and talked with the nurse and see told me my doctor was out of town, so I ask to see another and see told me i could not see any other doc and offered me medication, I told her I wanted to find out what was wrong with my back not to get medication, so see gave me traidal might not spell it the right way, it almost killed me, it made me pass out lowered my temp and made me fill like someone was watching me all the time had to change medication. called back 3 more time she refused to see me. I went to another hospital and made a compliant, the one i went to was a out patient clinic. I finely got a cat scan 2 week later on my back and had disk problems, I made a appointment to see my new doctor and it took 4 weeks from the day I hurt back and my new doctor made me a MRI appointment, 2 week later and it came back that my back had disk problems, narrowing of the canal of the spine, arthritis of the facets. The nurse did give me a week bed rest with out seeing me just wrote it out and medication, a doctor wrote it out with out seeing me the first week when I hurt my back. The problem is I should of been on bed rest for 2 or 3 weeks from the date I hurt my back but could not get that because I could not see a doctor other than the ER doctor I saw 2 time before i saw my new doctor, is there any thing i could do about this and i did get service connected on my back for this injury i just lost some percentage points for the time I lost for not being on bed rest. My new doctor did give me a work wave a month after I hurt my back so my back was hurting enough for him to give me that waver and I do not know how much more I hurt back from not seeing a doctor like the ER said to do.   22. I was reading i title 38 about the ankle, the ? is for ankle ankylosis, it says in plantar flexion, between 30 degrees and 40 degrees or in dorsiflexion 0 degrees and 10 degrees is 30 %. There was 35 degrees of plantar flexion with o degrees of dorsiflexion limited by pain, i got 10 % should i have not gotten 30 for the 35 degress of plantar flexion it is between 30 degrees and 40 degrees i could be wrong just needed to ask.   23. The first C&P was 10% for painful range of motion and a total of 20 for muscle spasms resulting in antalgic gate. the second C&P was 20% for forward flexion limited by pain to 40 degrees. THANKS KEN
  24. I have a question about a rating on my back. On the 4 august 2006 I was increased to 20% on my lumbar area of my back, for 10% as it says your evaluation was assigned based on previous VA examination showing painful motion of the lumbar spine. Your 20% evaluation is assigned on evidence showing spasms resulting in antalgic gait. On 7 march 2007 the evaluation of degenerative disc disease, lumbar spine, which is currently 20% disabling is continued based on VA exam report that forward flexion was limited by pain to 40 degrees. The question is the 20% for forward flexion to 40 degrees the same as the 20% for 20% for painful motion and the spasms resulting in antalgic gate? The other question is how does the bilateral factor work when you have a rating on your right and left ankle? THANK KEN
