  1. Ok, my DAV representative in DC, which is in the higher rankings, just sent me my decision via email.

Looks like my testicular issues was awarded 10 percent, and as of 2015, it has been awarded 40 percent!

The issue that was remanded was my PTSD. I was diagnosed in the military with anxiety and depression, but denied it for a rating. I filed for PTSD in 2014 with a SC of 70%. The appeal was for a backdate to my original appeal in 2009. It says in the decision that another C&P exam is requested and if I had any further information!

Looks like this was pretty successful!

    1. Denial is bad.  (This is NOT a denial)
    2. Remand is good.
    3. Approval is good

    Vync nailed it though.

The hard part is waiting to find out exactly what it is.  The BVA provides the AMC or VARO with instructions as to what steps to take.  In some cases the BVA tells the RO to revisit the claim with emphasis on one facet or another, in pursuit of "service connection".

    Ok. I appreciate it.

The original RO rated me at 0& for SC on testicle issues. I had filled for an increase. Is it better that it goes to the VARO or AMC? For time purposes and chances of "winning" ?

  2. When they remand a claim, it usually means they need to request additional information, request a C&P, etc... It would depend on the situation though. For example, if you were denied and they never did a C&P, they might have been ordered to get one scheduled, etc...

I would not view this as bad

I had several C&P regarding a hydrocelectomy, chronic epidimytis, and ED problems. With all C&P exams, all were in my favor. I've had several of these done from 2009 when I filled my original claim, until recently in 2015 when I was continuing to have debilitating pain.

I was originally rated at 0%, but had asked for an increase in the Appeal.

I feel pretty bummed. Does it go to AMC or does it go back to the RO?

  3. Yes, its a good thing.  You get a "new" date each time somebody picks up your file for some effort or another.  I have watched quite a few "timelines", and most have between 6 and 10 "with VLJ" entries before the "decision" is finally made.  And while "with VLJ" seems like the "last stop", there are sidetracks that you can be set on, such as "administrative action pending", or "awaiting records", or others, and those can last quite a while.

But yeah, I like it when my case is "with VLJ", and when it is, I hope that the next step is something like "pending decision notification".

I wouldn't make a habit of getting too excited about ebennies and your status. But, good luck to you on your appeal.

not sure if you saw my latest post. I received another date change within a week. That's 4 or 5 date changes now :)

  4. Like yourself, I have  a 2009 docket date, and am waiting at the BVA.  The crazy part of this is this is "normal" for VA.  Since you also have a 2009 docket date, Im gonna assume VA did a "lightning fast" move from your NOD to BVA certiification in "just" one year.  Lets also assume that you get a BVA decision promptly and VA again moves lightning fast and implements your decision and awards you money which arrives in lightning speed of "only"  one more year.  This means you could move from filing your NOD to getting your retro in "just" 8 years.  Does anyone else think waiting 8 years on VA to appeal is anything less than nuts?

Minus all the appropriate sarcasm, once BVA decides the appeal, does it really take a year for back pay and current amount changed to the proper percentage?

thank you for the detailed quick response! 3 date changes is pretty good, in about a month timeframe. My case has a 2009 docket number as well.

Couls you explain what the "administrative action pending" is? If everything stays on track, the next action should be pending decision notification?

    Thanks again,

  6. Hi Everyone,

    Long time lurker, first post.

I recently received a call from the DAV in Washington DC. A gentleman explained to me that he submitted my arguement to the BVA on Novemeber 3, 2015. Go back to 2009, that is when the BVA received my appeal.

For now, my case has been assigned to a veteran law judge and has had 3 date changes between November 3 and Dec 10. Is this a good thing? Haven't seen a whole lot of info on this specific part of the appeal.

    Thanks,

    SecFo03
