    Correct.  Veterans do not have to diagnose their own issues to apply for benefits for them.  Depression/PTSD/Anxiety are all rated on the same schedule.  It would be the same if you were service connected for depression, but you still have to have a doctors diagnosis of depression.  

    It's crazy to think the VA would deny anxiety and depression, with service treatment records showing medications, post deployment assessments, etc, then grant me PTSD 5 years later. Crazy. However, that 5 years that they denied me, I am going after, which has been remanded.

    Your working, employer making any accommodations for you, might you be earning marginal income when compared to non disabled vet doing the same sort of work in the community which you reside? Might want to check in with the VA Voc Rehab people to see what they say, regarding your SC affect on your employ-ability.

    Your 80%, so your not an FNG, how long did you walk around with a SC Rate-able condition before you filed the claim?

    Had it not been for your actual filing of your 1st claim, no one from the VA Rating Dept would be looking at your Med file, right. At 80%, you might be IU, ever filed for it?

    Not unusual for a VA Rater to indicate on an Award Letter, that an "Inferred IU Claim," is pending and the Vet never actually applied for it. The Rater saw something in the Claims file that indicates a possible Scheduler IU Award. It may have been the Vet had the (1) SC at 60% or (1) @ 40 with 2 more to 70% SC. Then there is always the possibility of a Rater Referring a Vet's claim to the Comp Director for a possible Extra-Scheduler Award.

    I lost 2 yrs+ of Retro due to procrastination and lack of knowledge, hasn't happened since.

    I got an inferred IU and then they denied me. Most likely because I was working. Argh.

    Getting SC for conditions you didn't even claim is better than winning the lottery, since you have to buy tickets to win that.  I have read on here about other Vets who got SC for claims they didn't even file.  How do I get some of that action?  Probably doesn't help me that my VARO is Philly!

     

    I've heard some crazy stuff about that VARO but San Diego is just about terrible. I hate to say it, but im sure my file just got moved to the dungeons of the VARO.

        Its because you wont get an effective date earlier than the first date the doc diagnosed PTSD.  Even if you applied in 1970, you wont get benefits until A DOCTOR says you have PTSD.  No diagnosis = no benefits.  A current diagnosis is one of the Caluga Triangle.   So, the VA wants to know when you were first diagnosed with PTSD.  Was it 2007, 2014, or some other time?  Your medical reports should reveal when you were first diagnosed with PTSD.  Your effective date is the later of the date you applied or the date the doc says you have PTSD.  

    That's esentially the email I just received my from my DAV rep. However, he is saying that the depression and anxiety may have been the precursor to the rating for the PTSD in 2014, which would be able to backdate this to my original anxiety and depression claim in 2009, that I was denied.

    Regardless of what decision they make, be sure you read it carefully and compare it to the rating criteria to verify they didn't lowball your decision.

    Lol, I should know better!!! Having worked for the government for over 12 years, the only thing I get on a consistent basis is a hard time!!!

    There are exceptions to this, such as if you applied within a year of discharge, and if you submitted new evidence.  

    Your private treatment records could help your effective date, or they could hurt you.  You can look over these records and then decide if you want to release them to VA or not.  You are not required to release private medical records, tho many Vets do just that to support their claim.  

    If your doc mentioned PTSD in an older medical exam, then you should release them to VA, by signing the release.  

    To be specific. I discharged in 2007. I filled for anxiety/depression in 2009. Which was denied. I filed for PTSD in 2014 for sh@&$ and giggles and was awarded 70%!!!

    The DAV told me that the PTSD I was awarded in 2014 should be dated as of 2009 because anxiety and depression are linked to the PTSD.

    So, I received a letter for my VARO regarding the remanded appeal that they need all my private doctors info for release.

    History for who don't know about my claim. My appeal was decided. I will receive a new percentage and pack pay.

    However, a portion was remanded for a PTSD backdate. Today I received a form regarding my appeal for release of medical records. Lol. My appeal is at my VARO in San Diego and they apparently need more evidence from any other providers. I'm already awarded PTSD in 2014. I'm just asking for a backdate of 2009. 

    Why in the world do they need a release of medical records for private physicians? How will this really matter for a date change? Mind boggling VA. The BVA agrees that my PTSD is good to go(70%), but they're saying that anxiety and depression that I was treated for after multiple deployments is different. Will be sending these forms back tomorrow :rollseyes:

    I currently have a claim, "Pending decision Approval". I looked at my current disabilities, currently rated at 70%. 

    On the pending disabilities that I requested, there is a new one, added a few days ago, "Major Depressive Disorder". I am confused on how this was added, since I did not claim it in the process. I am currently 70% PTSD.

    Can anyone explain why a claim I filled 3 months ago, all of a sudden has an addition to the claim, "Major Depressive Disorder"? Thank so much all!!!

In my case it was usually a good thing, as VA would either Reconsider the C&P Exam Doc Info, and look over it again, or Granted me a Couple Conditions that I did not even know or ask for.  After Multiple FDCs and 30 C&Ps in the last 2 years, believe me I know the Craziness that you are experiencing.     Thank you for he well wishes! I've had some of your similar experiences as well! Prep for decision has taken two weeks before, and now it's been over a month on this one. Not too sure but nothing is ever consistent or appears to be standardized. I'll try and keep everyone updated in the battles we all face.

    Some of the smarter Vets on here say not to get too wrapped up on the current status being shown on ebennies, but it's so hard to resist.  Especially since we're all waiting for life changing, life improving results.

    Haha. Our claims sound identical. My wife's claim has been in prep for decision at about the same time yours was. I figured they'd try and clear it before the new year, which was stupid on my part.

    I know ebenefits is like a lottery. I play it everyday in hopes that I'll win. Haha. I also have an appeal pending too. So it's like double the excitement. My wife says not to look everyday, but it's so hard to resist. 

    I feel that they sit around with darts and a flow chart and decide what claim to work on and what evidence is important.

    The DOCS that were requested were the doctor appointments that I had months ago. Man, does it take over a month to update ebenefits. Maybe they're still reviewing evidence.

  14. Hey everyone!

    Long time lurker. Long time VA fighter. Had a quick question.

    One of my claims is in the evidence phase. I've been to the two requested C&P appointments. Those were supposed to be due and submitted to the VA on Dec 2, 2015. 

    Now, it's just says past due, which it's been like that for over a month. Anyone have any idea or comments to what may be going on? Thanks!

  15. I don't think anyone would venture a guess as to an average time. My remand went from prep for decision to awaiting decision approval back to gathering of evidence before it was decided. It could be within 30 days, or ??? Depends on your RO, their workload and the complexity of the claim.

    Since this is a new claim, I'm hoping it's the 2-4 weeks that I've seen in the past. Like you noted, they never did a C&P exam, so it might end up back in evidence phase.
