  1. If you have put in for a increase, and your conditions warrant a increase, then they will give you a increase. If you meet the criteria for TDIU in addition to the increase, and you have filed for it, they will award that, too.

    Example: You are at a combined 30% now. You file for a increase and TDIU at the same time. Your C&P's warrant a increase to a combined 70%, and they award you TDIU at the same time. Then a year from now you feel a little better and return to work. You send the VARO a letter explaining that you have returned to work. They cancel your TDIU and your rating falls back to 70%, instead of 30%. They would most likely call you in for new C&P's as well to see if they can reduce your combined rating.

    Thanks. That makes perfect sense. I'm not really concerned about being called back in for follow up cp's since I doubt my hearing will get any better, and my medication for depression keeps me stable. I doubt that would be grounds for decreased rating or at least I hope not :). thanks again rentalguy1.

  2. I was 70% when I requested MRI's for my back and knees, and filled out the IU paperwork at the same time... They granted the IU, bumping me to 100%, and I didn't hear anything again about a new rating for my back and knees...

    so if you eventually return to work would you then have to reopen/restart your increase rating claim. I'm thinking I would rather have the increase rating and not IU because although its been a almost a year since I've worked I would like to return to work. thanks for moving for me Carlie :)

  3. Navydoc, that sounds 'good', however, who told you they sent the letters? Have you officially applied for VA unemployability? Its possible that someone at the varo is helping things along for you. You mentioned vocational rehabilitation, did you recieve any feedback that your counselor though you were unemployable? That would certainly strengthen your case.

    Also, you can request a copy of your compensation exam(s) and anything else the VA has on you. Compensation file, service medical records and vocational rehabilitation records. Hang in there, Fridays coming.

    There are no guarantees with the VA process and our struggle for benefits. Thats why Hadit came about. Someone is always here trying to unravel VA disability compensation mysteries and fighting for whats due. Go ahead ask questions - it'll surprise ya what a vet can learn here.

    I called the 800 number and spoke to a rep there and was told that the letters were sent to my employers. No cowgirl I don't think I officiall applied for unemployability, I filled out the original paperrwork to support my claim for increased depression and new rating for bilateral hearing loss/tinnitus and after I sent that paperwork in they sent me that individual unemployability form. I have not talked to my counselor, but when I went for the interview for this semester I told her that I was not working. That was before my rating request though.

  4. I was told yesterday that letters were sent to the jobs I worked. This should be interesting since the job I worked at for over four years told me I was involuntarily resigned and when I applied for unemployment benies they said it was for cause. I guess I'll just have to wait and see. The other job lasted less than six months.

  5. You should apply for Social Security Disability today. Go to their web site and apply. For most Social Security is a lot easier than our beloved VA.

    Like it or not you have not worked for almost 1 year and many make the mistake of waiting to long to apply for Social Security.

    Depression can be a real bitch and most medications don't make you well they just enable you to maintain a level emotional state.

    Sorry to be blunt but I went through it myself. Even if VA and Social Security just pay for awhile till you get back on your feet you earned the benefits just like the rest of us.

    No worries I like blunt. will filing for ssi affect my claim with va or vice versa don't want to get caught between two government agencies and slip through crack. thanks

    If I were scheduled to start voc-rehab, I would do just so.

    If it works out --- good for you.

    If it doesn't work out due to your service connected disabilities,

    voc-rehab providing evidence to that effect would be helpful for an IU claim.

    BTW - when you want to bring in a new topic such as voc-rehab

    please start a new thread.

    Oops! sorry won't happen again. So as I'm understanding it you are saying that even though my claim was not put in for increased s/c disability until late Feb. The rater may grand 100% schedular back to when I was unemployed and then increase my rating to whatever XX%?

    Under certain conditions, if a veteran is rated at less than

    100 % schedular SC'd and if VA decide you have the right evidence,

    meet the requirements - and the decision maker promulgates a correct

    decision, then even though the veteran is rated at XX% OR increased to

    say 60, 70 or 80 % - then the VA will compensate the veteran at the 100% rate.

    If that happens for you --- then you will want to learn about a thing called P&T.

    thank you Carlie, I will look into that. Does that mean I would have to stop voc rehab which i'm due to start next month provided I'm still stable on my meds and my doc give the go ahead to my counselor.

  8. Once the VA gets a 21-8940 TDIU form they will consider you for TDIU- it is paid at the 100% SC comp rate.

    The VA will award TDIU upon receipt of this form to any vet (regardless of established rating) whose SC prevents them from becoming employed.

    RTell them of any side affects of your meds, that would hinder employment and anything else that could impact on the TDIU claim-

    If you do not receive SSA disability- check yes to where it asks if you are applying for SSA and apply for SSA.

    If you receive SSA now for this same disability make sure they know that- you can attach more pages- refer to additional pages under # 25 Remarks,put your c file # on everything and copy it all before signing and sending it all to them.

    I have not applied for SSA was not thinking I would be out of work this long was just not working until stable on my meds which to be honest I was not thinking it would take this long, but financially I'm struggling on what I get now and am well robbing Peter to pay Paul and more often than not someone does not get paid at all.

    I think the VA is considering a claim for inferred TDIU. That is good since you must have met the percentage requirements. Are you working? If you did not request TDIU and the VA sent you the paperwork they must have a reason for sending you this stuff. If you are not working then this is a good sign in my opinion. It means you are getting a higher rating that puts you in the TDIU ballpark.

    I am not working I have not worked since June of last year, I did not apply for an increase to my depression until late Feb along with bilateral hearing loss and tinnitus. So will TDIU take the place of my rating increase or will they still rate me? Are they together i'm confused since I thought I'd filled out all of their paperwork and here they are sending me something I was not asking for or expected after my QTC exams by psychologist and audiologist. Will I be able to get copies of those exams to see what they said? I know I have alot of questions :unsure: thanks

I recently applied for increased rating of depression and bilateral hearing loss with tinnitis. I went to my QTC exams and also filled out the paperwork they sent me and returned it. Now a few weeks ago I received another pile of papers to fill out talking about individual unemployability. My question is what in tdui and does this take the place of my increased rating request or do they go together. I've tried to talk to my RSO about it but can't get through to him I know they are busy, so I thought I would ask for help here. thanks in advance.

  12. Welcome Navydoc, Thank you for your service. Hadit is a 'home forum' to many of us here. Probably as many questions as answers, but we continue to try to get whats due!
