  1. Carlie What if Ebenefits never shows the claim in the Decision and notification statuses, but rather goes from Gathering evidence straight to the COMPLETE status. Thank you for explaining the first 3 Ebenefits statuses. Lois
  2. All Recently a Vet that I am assiting received a SOC for a condition that she obviously did not claim. Her repeated letters to have the incorrect condition changed before the DRO review was no acted upon. What does she do now. Will this have to be sent to the BVA to get settled? Any response with guidance that I can share with the Veteran will be greatly appreciated! Lois
  3. A Veteran that I am assisting received a denial letter from VA for a condition that he did not apply for. VA stated that the condition *incorrectly claimed) was not shown to be an in service occurence. I reviewed the Veterans SMRs and discovered that the correct claimed condition is shown to be associated and diagnosed during his active duty service. She submitted a NOD last year informing VA of the mistake and was notified by her VSO recently that the status database shows that a SOC was being written by the examiner for a VA generic condition that includes her condition. Very important Question: Can the examiner provide a statement of the case denying the incorrect condition without acknowledging and providing a VCAA notice for the correct claimed condition. Lois
  4. Carlie Yes fast letter 08-41 is on these sites but there is no current issues. Just the same repeated old information about what is supposed to happen, but no issues from political interest or VA responding to the mishandling or diregard/delay of Veterans claims that are being requested to be reconsideration under the temporary authority. It seems that noone wants to touch and just want it to go away like past VA issues where the Veterans documents were either lost or mishandled. Lois
  5. Free It really concerns me that your claim is being treated this way. On that note, I have a Veteran friend that I am assisting going through the same situation (no acknowledgement of receipt of fast letter reconsideration or evidence that he submitted many years ago) despite the Fast Letter Instructions. While there are Laws, rules, regulagtions, fast letters, Court Decisions and etc. that supposed to be adhered to by the VAROs, the problem is that there is nobody, to include the Office of Veterans Administration Inspection General, that has a personal interest of the individual veteran. One Vet informed me that he wrote the VAOIG Hotline last year and did not get as much of a receipt confirmation from the site. Despite the many substantiated complaints that Veterans make in regards to the treatment of thier claims, there is only temporary solutions that are like short candles that burn out quickly and the veterans are again in the dark. While these forums are a good place for gathering information on how to best file and track your your claim, it will do nothing to change the VARO claim delays. The reconsiderations submitted under Secretary Peake's fast letter 08-41, is not even being discussed in any particular polictical or for that matter Veterans forums. Check it out if you do not believe me! Fast Letter 08-41 is old news on any internet search engine site. While the claim is important to you, please do not stress over it to much, that will only keep you stressed out! If you have done all that you can do, my recommendation is to just wait it out-WITHOUT STRESSING LIKE MANY VETERANS DO! TAKE CARE AND GOOD LUCK!   7. Berta Thank you for the feed back! My daughters miltary treatment records were sent from a St. Louis records center to VA, but VA continues to ask her if she has a copy because VA is statint that they do not have the records. VA does not say that they never recieved the medical records. Lois
  8. Is VA held responsible for documents sent from another federal agency that was subsequently misplaced or lost while in there possession?
