    Still have some bugs to work out, hopefully we will be able to find a control for that.

    I need help with my claim for ptsd which I just got out of the hospital for, sucicidal, one on one observasation in CCU, because they had no beds, but now I am over that, I am still seeing an DR. Pchy. for mst/ptsd, and a social worker, but I got a letter last week stating I was denied all benifiets or PTSD/MST, and I want to know why??

    Please help me.

    Please start your own thread and give Members a chance to try and help. Hijacking threads will not get you answers as many here will ignore your posts on someone elses thread.

    You also need to do some research on your own if you can ask here you can also use Hadit Home Page and search features.

  4. If you are having problems getting a C&P the best thing in my opinion is to request a Hearing and a quick one at that. The VARO has to at least give you a hearing where you can ask what it takes to get a C&P and fair treatment

  6. On page 8 of the htm of the new regs it says:

    Retro estimated at $12,286,048 *

    Then the asterick adds:

    "Retroactive benefits costs are paid in the first year only."

    ????

    They actually estimate that 11 years of retro are going to be an average payment due veterans under this new reg-figuring an estimate of past denied claims-

    but I cannot comprehend the 'first year only' phrase-

    I wonder if it means no retro will be paid unless claim is filed within a year?That would be BS pure and simple.

    I guess I better read this real good and comment at Fed Register on it-

    Page 9 is a doozy- "of the total 52,918 currently on the rolls ,8,348 are currently rated 100 percent disabled and ,therefore,would not likely receive a retroactive payment."

    Say what?

    If a vet is currently 100% for PTSD- their IHD (which VA averaged at a possible 60%SC for many claimants in this reg)

    then 60% for AO IHD as an independent SC disability - would put them into retro SMC.

    what do they mean no retro-with the new SC then the SMC would have to be an inferred issue under Nehmer-

    I know the vets lawyers are pouring over this as well as vet advocates-and these are the questions that must be raised.

    any thoughts here on these aspects of VA's Proposed rule?

  7. Hi all. Like the title says, I've applied to go through the process in hopes to get Independent Living Services. I'm 100% P&T and tried the going to work thing, getting a scathing letter back from the RO Director (via my local Senator) saying if I tried to work it could hurt my VA disability compensation/or my disabilities MAY have improved. Well I can't set around the house any more, I have done this for 13-yrs. I feel like a caged Tiger. My physical Disabilities are not bad enough that I can't get outside and move around (lucky me, I feel for those that can't). Setting around makes my physical problems just as bad or worse than getting physical exercise. So it comes down to my Psychological health, sitting around the house makes my depression worse. But getting out and doing Physical things is painful but makes my Depression better. Sooooo is there any chance in hell the VA will help me under the ILS program or are they going to tell me (that's a hobby) and we ain't gonna help you. I hope this make sense, I'm half in the bag and this would be the ONLY time I would discuss my personal prob's on line.

  8. I got my decisions on my VA claims. Depression 10%, not otherwise associated with bilateral hearing loss. Bilateral hearing loss 0%

    (not bad enough to warrant compensation). Denied Meniere's disease and lung fibrosis as not related to military service. Denied PTSD because the examiner stated that I did not meet the criteria for a diagnosis for PTSD. ED deferred because more information is needed from VA C&P examination.

    So now I have 10% tinnitus and 10% depression. I am trying to make arrangements to see my C-file in Houston because evidence I provided was not listed as having been used to make the decisions.

    Plus on the lung fibrosis claim the evidence I provided were not listed, which were a copy of a recent CT-scan identifying mild asbestosis, a complete listing of occupations before and after military enlistment, an official Navy listing that I worked as an Engine man and Boiler Technician in my military occupations, and a copy of the PIES listing found on Hadit that listed the both Navy occupations as highly probable to lead to asbestos exposure. Needless to say I am disappointed, but I am glad that was not totally denied. Now it is on to the next step. What would you all recommend as to what I should do next besides seeing my file, please provide input? Thanks.

  9. Hello I know it is logical but would PTSD affect a persons Blood pressure? I had a guy in my group the other night who is SC for PTSD and he said he got his Hypertension connected to his PTSD. Any Ideas of if this is logical? I know that if something that is not SC and it agrivates a SC condition it is rated as if the Non SC were SC. Am I right on this? Have a good day I was wondering if anyone had heard of it.

  11. My 2 cents: Remember the VA always loves to make things more complicated than they are, giving them more chances to deny. Ultimately, you will have 2 seperate issues:

    1. Service connection for your overlooked condition. You can use the docs opinion, plus more evidence, to try to get it service connected.

    2. The Effective date. The VA most always gives you what Jack Dempsey calls the "one-two" punch. First, the VA tries everything to keep you from being service connected. Then, after you do win service connection, they manipulate the effective date to make it appear like you didnt apply until yesterday for benefits you had really been seeking for decades.

    The VA does not want the Veteran to "have any peace", but rather is in a constant war for benefits, always hoping you will give up. They keep on fighting you, even when, the US Supreme Court Justice says, "The governments position is largely unsubstantianted in about 70% of the BVA cases". The VA knows that even when they have a weak case against the Veteran, there is still about a 50% chance the Veteran will die/ give up or simply become too sick to continue the fight before he gets his benefits. As the Captain says, "Never give up."

    This is so true even with my case I now have 23 issues that have developed, since I got out of service incuding, PTSD/MST, EED, and on and on, so I agree do not give up ever!!!!

    Is your rating at NSC "0" or SC "0"?

    For IU due to PTSD you must establish that the PTSD is due to your service and that medical evidence would warrant an IU rating.

    After you file a formal claim then a C & P exam will be ordered.

    Unless you have the CAR, CIB, or the PH on your DD 214-you will need to prove the nexus to your service-that is the VA will need proof of whatever event caused the PTSD.

    A IU rating involves a SC disability that pevents you from wprking- solely due to the IU SCdisabilities.

    All I have is the Pchychiaritist that I am seein now, and his report along with the MST councleor that I am seeing and my DR has me on antidepressentants due to my PTSD, he is willing to write me a letter to that fact and my current gaf is 45. That is all I know for know He knows I can not work due to my PTSD, and my Neuropathy, with loss of use of my right hand due to chemo I recieved at the Loma Linda VAMC for Hodgiks Disease.

Erich,everyone gave you some good information,but make sure you read and comprehend what john999 wrote,because that is some very good information.If you are still having flashbacks about getting wounded by that grenade, that is a stressor withthan itself and you definite have PTSD.(1)Being diagnose with ptsd (2)Wounded by grenade (3)Having nitemares about it.those are the three things it takes to get service connected for post-traumatic stress disorder,but remember you have to be diagnose by a clinical psychologist or a psychiatrist and it is best to get you a private psy.

  14. I hope someone can offer a workable suggestion. I have been attempting for 9 years to file a claim for PTSD due to multiple incidents of MST. I've made slow progress. I placed a phone call which confirmed the worthiness of my claim. I tried to enter the VA hospital and failed. Next accompanied by a nurse i did enter, only to leave. Several years later I barely made it in to get a va card made and receive a Rx for PTSD (Zoloft). During this my marriage failed due mostly to the PTSD. Years later after I lost my job (due to PTSD). I managed again only with a nurse helping me; to continue to get zoloft. Eventually, after losing my home, I managed to have a few visits with the head of the MST dept. This only after rescheduling my initial visit many times. I would have to leave when I would have major panic attacks just trying to sit in the waiting area. Eventually I was allowed to skip the initial processing and see the Dr. I only lasted a handful of times as I began having many sleepless nights and increased anxiety it wasn't worth it. Now my question. I was able to give accounts of many of the incidents to this Dr. There were multiple but she heard the majority. I don't have a record of actual reports of the incidents as I did not want anyone to know. However I was seen multiple times for "stomach problems". I was even admitted to the base hospital and "surprise, surprise" My symptoms went away and the tests showed nothing! I was given 2 weeks conv. leave on release, which I recently read in my record was not for any "medical" reason. The Dr stated that he felt my symptoms were psychological in nature! I also have in record where I went to sick call and asked to be tested for std's. I stated that my "boyfriend" was rumored to have something. I did not have a boyfriend. To my relief the tests came back all negative. However ironically the Dr. had started me on antibiotics due to my "exam". I appeared in severe pain and what he did see was very "irritated". This Dr never suspected anything. Since my 9 years of service I have been admitted by ambulance to the cardiac wing for observation from the er, only to find that my heart was quite healthy. I think these were major panic attacks. This was when my Dr started me on zoloft. I also suffer from migraines (1st diagnosed in service) high bloodpressure and asthma. My stomach problems have also continued.

    ***Is it possible with current records and documents to file a claim without subjecting myself to the anxiety of once again visiting the VA? This is long but if anyone has any suggestions please help.(A major factor for me is that 1 indiv. involved retired near me, I barely leave my house for fear of seeing him.) I have lost basically everything. My marriage, job and home.

    bERTA, aLL i HAVE IS MY OWN VERBAL COMPLAINT THAT i WAS RAPED IN BASIC TRAINING AT fT. kNOX, kY. AND i CAN PICK HIM OUT TO THIS DAY AND MY DRILL SARGENT AND MY BARRACKS SARGENT, HE IS THE ONE THAT TOLD ME TO FORGET ABOUT IT "SOLDIER", AND GET BACK IN YOUR BUNK!!, i AM NOW SEEING A PCHYSCHIATRIST AND HE HAS ME ON MEDS AND I HAVE SUFFERED 2 MAJOR HEART ATTACKS DUE TO THIS PERSON I AM NOW 57 YEARS OLD AND DO NOT EVEN WANT TO THINK ABOUT A RELATION SHIP I DO HAVE A FEW LIKE 1-2 FRIENDS THAT I HAVE TOLD, BUT NO ONE ELSE AND IT IS REALLY STARING TO TAKE IT'S TOLL ON ME FOR SURE BUT THANKS FOR LISTENING, LOMA LINDA- BILL
