Privacy Act Amendment Note

Hi to all,

Does anyone know why the Two Quack Psychiatrist sent their copy of my C&P to the Regional Office without any Amendment.

Three days later, I picked up a copy at the VAMC.

I was astonished by what the lady quack had written down.

I immediately sent a " Formal Written Rebuttal" and ask for the incorrect statements to be removed and the medical evidence that had been changed.

The quack refused to remove the in- correct statements.

When the nurse wrote a " Statement for me", as she saw my confusion after the C&P and treated me with a follow-up telephone call.

Her statement was tacked on to another copy of the same C&P and one month later Dr L had placed in bold type

PRIVACY ACT AMENDMENT NOTE - you may not VIEW this exam.

Why would someone do this, knowing that I had a copy of the exam and had filed a formal complaint.

Am I just dumb? You don't have to answer that question.

Betty, try cfr 38 3105a,I wonder why this cfr,Is not used,for clear unmistakable error,and It the back door to cue,your papers will be accepted as correct,under3105a,any thing you have is proof read the cfr 3105a,also always fax ,certified,to me is useless,va can come back with we have received you certifide,or tracting,the va will and can come back ,what was IN iT,when you fax,also stat this fax will comfire as received,and dated,I also put I waive all revied by varo, and amc,you now have the door opened to file 5109a,at bva yourself,over 65? request top of docket,this Is your right,as a veteral amc fax 202-530 9216 I hope this helps you veteran,you have tried so hard,keep up your good work, Bradon

Not quite 65 yet, but appears that I will be before this case is settled.

This is from the remand:

After the above development has been completed, the veteran's claims file should returned to the board of VA psychiatrists who participated in the April 2005 examination for clarification

of the provided opinion. They should be requested to review the record and reconcile their opinion as to etiology in light of the evidence added since their examination of the veteran, including the

May 2005 statement of Dr. Brian C.Cxxxxx and the January 2006 statement of Dr. Michael Pxxxx.

Brandon, the AMC sent this down to the two Psychiatrist October 2006 and they would not comply.

The AMC has sent it back to them again this November. There answer is on the Aimee and has not been opened as of Friday.

I guess that I can pick up a copy tomorrow. I have no ideal of what they have done this time.

I have instructed the Rating Specialist with the following:

To the Rating Specialist: This statement in support of claim, as my claims file has been sent back to the VAMC for “ New Opinion”, November 2007, having been sent to VAMC also October 2006 for “ New Medical Opinion”. Rate the claim with the evidence that you have after you receive your “ New Medical Opinion”. I shall expect a fair and just rating per Chapter 38, Code of Regulations. I have advanced on the docket March 06, 2006, signed by Nancy Robin and have provided you a copy of this document. I have been at the AMC for almost 800 days. My claims file lay idle in filing cabinet for one year after the “ New Opinion” October 2006. I shall not wait for another year after this “ New Opinion” is acquired. Writ of Mandamus will be my next step.

I sent a complete copy of all of this mess to Michael Walcoff's office to see what is going on with my claim and for any assistance.

Betty,I had a remand,on 1-5-07,without my knodledge my so called rova,sent to Bva,I had a poa with the ro,NOt TRUE, privacy dept In Washington,sent me a copy,I have not had a so or poa for over 5 years,yes rova did have a copy of my old poa,and tried to use it to close out my remand,and they did on 3-2-07,as I have all fax,s,sent and saved,I had a form,orded to vacate,I had my fax from 5 ys ago,I sent the Judge a copy,the remand was upheld and signed by Judge on 1-5-07 va plays many games,YOU NEED TO GET OUT OF AMC,read 38 cfr 3105a,I know IT worked for me .IF any of you papera state IN THE LINE OF DUTY,under 3105a this will be accepted,as a clear unmistakable error,ther IS more listed,read 3105a .Request you do not want your varo to review,your papers,I really fell you will get a 5109a, you do not need rova,to send your files to BVA under 5109a, I hope this helps Bradon
