Dealing With A Letter To Propose To Reduce - Lflint33

Hello everyone I need to find out the best way to deal with a letter to reduce my rating from 100 % to 90 % . I was 70 % for Depressive disorder secondary to chronic low back pain and now they want to drop it to 50 % . My back hurt me all the time it has not got better and my Dr at the Va has my gaf a 50 since 2004 and I go to Q T C and he give me a 51 gaf and said I was not cooperative and he noted I occasional difficulty have problems performing daily living and this is not true.

The VA knows they are violating their own regulations to propose a reduction based on a single exam if you are disabled for more than five years or totally disabled. The do these things because they know that like in "snap the whip" they will be able to reduce a certain number of vets who don't or can't fight back. The Veteran Benefits Manual clearly points out that the VA has a heavy burden when they propose to reduce vets.

You can not select QTC. I have always gone to QTC docs for the C&P exam until my last 2 exams. They were done by doctors who contract with QTC. The way I understand it is that if you have QTC office closer to you than the VAMC you will get an appt with them. If you are closer to the VAMC then you will get an appt with them. I have had 5 C&P exams and only one was horsesh**. That doctor took less than 5 minutes with the exam and next thing I know VA wants to cut me from 50% to 30% based on one exam. I got an IMO and asked for a personal hearing. Long story short VA relented and left it at 50%. DJ8 :)

GREAT!!!!!! Good for you! Do you have documentation from the doc who said your back is not going to get better? To bring with you?

As I understand the regs they CANNOT reduce your comp if you request a hearing-

they only reduced my husbands comp because he asked them too- and they paid it back to him some months later.

Like I said ABC News wants to do a story/investigation on QTC. If you have or are to have an exam with QTC, you might want to get a hold of me so I can get you in the "line" to speak to the proper people at ABC. It's completely up to you. I smell something "Fishy" with this whole ordeal.
