Smc Cue Claims

Question

A veteran should never overlook that they might be getting SMC now but that the VA might have erred in a past decision by assigning the wrong SMC level or by not even considering them for SMC when the medical evidence clearly warranted SMC consideration.

Marlowe V Brown is discussed in the VBM (NVLSP) as a successful CUE claim regarding SMC.

Marlowe received a RO decision in 1948. He was service connected for complete spastic paralysis of the right side.He also was prone to cnvulsions and had aphasia.

The RO awarded him SMC "M". he didnt appeal this but years later realised they had committed a CUE.(He filed the CUE sometime in the 1990s.

The VA agreed and paid him retro for the "0" award back to 1948.

I had thought I knew what "cue" was but was mistaken. As defined, I have not incurred any such yet.

Thanks for the clarification.

I also clearly was way off the mark in what I thought SMC might be.

It's not that I mind taking the effort to look up things, it's just that in running a search, such as "cue" it crops up every time the term is used and the results rendered can be daunting and bewildering.

I know there is a how to search hadit.com video in the stickies but my clunky old rural dial up doesn't run video worth a durn.

there are tricks to searching for example

Searching with the following keywords can help narrow the search down (try the seaches below here)

cue (Returns any page that has cue in it)

cue +ptsd (Returns only pages that contain cue and ptsd)

cue +smc (Returns only pages that contain cue and smc)

cue +smc -ptsd (Returns pages that contain cue and smc but NOT ptsd)

cue -/forums/ (Returns all pages that contain cue but not if they are in the forum, this would allow you to easily see what content is available on the main site.
