C+p Exam Tomorow

Rate this question

Jim MAC

Question

On Feb 29th I filed for an increase for service connection for my back now rated at 10 percent for stress headaches for my back and for an increase for my service connected Sinusitis. Well its only april and I am already scheduled for a C+P exam tomorow for my o percent sc sinusitis. Since Jan of this year I have been seen at the VA medical center 3 times for a sinuitis condtion. Do you think I got a shot for a higher rateing. All 3 times put on antibaitoics, Don't know what is happening with the other 2 issues. All my health care has been at the VA medical center.

Thanks for your support

I think that you have a very good shot at it.

Three times since January with antibotics can as you know

turn into a more serious condition.

Good Luck,

Josephine

I think you could possibly get 30% if you answer the examiner's questions the right way. i don't think that you would meet the incapacitating episodes requirement, unless your doctor ordered bedrest and the antibiotic treatments lasted 4-6 weeks each time. But since you've been treated that often, it shouldn't be hard to prove more than 6 (that would mean 7, if the question is asked) non-incapcitating episodes in the last year.

From 38 CFR 4.97:

General Rating Formula for Sinusitis (DC’s 6510 through 6514):

Following radical surgery with chronic osteomyelitis, or; near

constant sinusitis characterized by headaches, pain and

tenderness of affected sinus, and purulent discharge or

crusting after repeated surgeries 50

Three or more incapacitating episodes per year of sinusitis requiring

prolonged (lasting four to six weeks) antibiotic treatment, or;

more than six non-incapacitating episodes per year of sinusitis

characterized by headaches, pain, and purulent discharge or

crusting 30

One or two incapacitating episodes per year of sinusitis requiring

prolonged (lasting four to six weeks) antibiotic treatment, or;

three to six non-incapacitating episodes per year of sinusitis

characterized by headaches, pain, and purulent discharge or

crusting 10

Detected by X-ray only 0

Note: An incapacitating episode of sinusitis means one that requires bed rest and treatment by a physician.
