Had Our Bva Hearing

HI ALL WHO HAVE FOLLOWED OUR CLAIM- WE WENT TO OUR TELE-BVA HEARING-

FIRST, THEY HAD EVERYONE SCHEDULED FOR NOON--9 OTHERS WERE IN THE WAITING AREA.

NEEDLESS TO SAY 3 PEOPLE HAD LEFT AND DIDN'T WANT TO WAIT THAT LONG-- SOME HAD NO REPS WITH THEM- AND WE HAD 2 ATTYS. AND PARALEGAL WITH US.

WE GOT IN FIRST- WHEW!!

THE JUDGE (THERE WAS ONLY ONE AND NOT FIVE LIKE WE WERE LEAD TO BELIEVE)

she would only let one atty. represent to lead the hearing- at this time they faxed her over the latest IMO that we got 2 days before the hearing- then the atty. wentover all the 3 IMOs

the SS disability payment records- the stressor that was verified by the VA- the buddy statements-the stressors-my husbands testimony- mine-

it seemed like the DRO hearing- why was there only one in front- were they busy that day?

has anyone else had the same thing recently-

THE ATTYS. FEEL IT WENT VERY WELL- AND THEN TOOK US TO LUNCH AT THE LOCAL CASINO!

ANYONE WHO CAN CONCUR?

I haven't been to a tele-conference. You are only describing 1 judge, and I think you mean it was a Video Conference BVA hearing. I had the Video Conference BVA hearing. Good you got in first.

I represented myself/hadit. The nice part about it was submitting evidence directly to the judge and that it was on the record. I have a feeling that some of my evidence, prior to this hearing, was stuffed in the round file at the VA. At my hearing there was only one judge.

Now the VA had to read, what was submitted to the judge and per the judges request. He also said that there would have to be a new FOIA for the SMR's requested. Another stall.

The Judge requested a complete copy of my Service Records. I know the reason for this request of a complete copy of Service Records, was because I submitted Service Records, that I had kept, and that the VA did not use or submit to the judge. He knew that there were other records, that were withheld by someone, as my copies were original copies. I pointed out that these records were withheld.

I ended up with about 5 remands and 1 Grant. The remands are still at the AMC or VARO.

Good luck. Sounds like it went well, to me.

As I understand it one Judge conducts the Hearing than writes it up and a panel of three decide yes or no than they finish what they can do and send it on.

If your Attorneys are happy with the Hearing I suspect that it went well and the evidence you have should be a slam dunk.

Good Luck hang in just a little longer.

You were not at the Supereme Court hahahahaaha just kidding. All BVA hearings are in front of 1 judge. If you had to wait on 5 of them to attend the hearing you would never get a hearing.

He/she will take their notes to their team of attorneys on staff. The attorneys will review the hearing, look at the notes and the other evidence in the case, research the law affecting your case and write up the decision letter. It then goes back to the judge that held your hearing and he/she will sign it.

Ricky is correct - ONE judge.

Chances are very high that if you have more than

one issue at BVA, part of your claim will get remanded

either to the AMC or back to your RO.

Hope you are right on- I can't see with all our evidence and IMOs and verified stressors and buddy statements and the fact my hub is on SS solely for PTSD- how it could be any otherwise- how long did you have to wait for "the letter" after your hearing?

I believe the attys. signed a waiver to keep it from going back to the vverrrrrrrrrry slllloooowww RO- and only focused on the issues in which my hub is getting SS for PTSD and NSC for his prostate and the IU issue- I dont believe there is any other way it can go- the VA verified stressors- admits PTSD- and bladder calculi and hypertrophy

of the prostate- I've fought this 10 years soon to be 11- how long do they take to make a decision?
