Question

I guess they are trying to tell me back then, that everything in my records was against approving my claim. :P

Dear Mr. XXXX:

This is regarding your reopend claim for entitlement to service connection for your nervous condition.

All the evidence of record has been reviewed including summery report from Butte County Mental Health. The evidence does not warrant any change to our previous denial for service connection for your nervous condition.

Sincerely yours,

Harry E. XXXX

Adjudication Officer

Don't laugh, this is the sort of thing they did back then and Veterans like me, had no clue that this was garbage and could challenge this sort of thing.

Jim, Did you Appeal the 1979 Denial?

Wings: If they had given me information that said I could appeal, I probably would have, but I knew nothing about my rights as a veteran and the VA nor the Service Orginization was forthe coming with any as you can tell by the letter of denial.

This lack of information as to the reason and basis for their decision and for the lack of information that supported a diagnosis change is the crutch of my claim. Even if things go to the BVA, I doubt the COVA will accept this letter or the change in the diagnosis, because of their lack of reason and basis.

I'm waiting now for my new SO to report for work, so I can discuss my claim with him. I hope he is open minded and is ready to get his feet wet. with or without him I will procede with my claim.

Was the VARO doing "reasons and bases" in 1979?

What was the "Enclosure VAF 1-XXXX" all about?

Jim,

This looks like a corbon copy of several denials I got in the 1970's.

The VA didn't tell the vet shit so you couldn't know how to fight them.

I got one in 1974 so they should have been giving Reason and Baisis in 1979

I think the enclosure was my rule and such for an appeal, of course I had no idea what to appeal, I didn't know anything back then. It's not much different now, if you don't ask, the VA isn't telling.
