I believe I asked U this question before but as U know my memory completly sucks.

OK..U know what I'm comped for but I have to Oct. to file for Incompetence.

Is this worth filing for?

I found the award letter for L1 & it said incompetence pending.

& I have been rated as such.

So, looks like a go for me what do U think?

Gary-I answered this but forget where and when-

Yes we discussed here that this is best for you- you trust the wife and hopefully VA has checked her out by now- have they? They usually make home visit.

I believe that an incompetence declaration by VA protects a SC rating.

How can they take it back,say you are competent, and then attempt to reduce?

I dont think they could- I see this as a protection for vets- some vets I personally know are very glad VA declared them incompetent.

SSA declared my husband incompetent but VA didnt- SSA gave him opportunity to appeal this but he said he liked it.

He told the SSA woman this way when the student loan people badgered him- he could say he had PTSD, significsnt brain damage and also was declared incompetent and maybe they would stop calling.

Funny thing- he was told even though his student loan was almost paid off- not to make further payments when he was totally disabled.

They badgered us here relentlessly calling and calling and we asked his doctor at the VA what we could do- this was prior to Do Not call registry-

the doc asked us to get a specific form , filled it out and signed it and then when student loan people got it they mailed to him that the ,loan was voided completely due to his total & permanent disability-which was under 1151 not SC at that time.

Dont worry about this Gary.I think the VA will do the right thing for you and give you the higher rating and maybe declare you incompetent-which doesnt really mean anything at all-just for VA comp checks.
