If the BVA denied than you have 60 days and as soon as you file you will be contacted by plenty of lawyers. I am sure that some Hadit members who are using Lawyers will chime in soon. Berta Posted May 20, 2009 Share Posted May 20, 2009 Did you get a letter saying you have 30 days in which to respond? The 30 day part might say you can ask for 60 days to respond but you still have to tell them this within 30 days- read the SOC carefully= response times of 60 days have been changed in most cases to 30 days. Pete - I never heard from any lawyer when I was at the BVA. 12 of them however contaced me when I filed a writ of mandamus at the CAVC. I mentioned NOVA in another post this vet made- they have a list of BVA and CAVC lawyers at their web site. Rich Cohen-fabulous vets lawyer himself- will also respond to any email as time allows with any questions as to the list of lawyers-his email contact page is there-he is Executive Director-NOV, has goiven much testimony to the H VAC and was my guest at SVR radio last year and due for a come back there as he was a great guest to have- it was a very informative show- Still the reason they denied is what must be overcome by evidence. free_spirit_etc Posted May 20, 2009 Share Posted May 20, 2009 That is nice to know - that when you file, lawyers will contact you. I had a horrid time trying to find a lawyer for our SSA claims. Most lawyers handle disability. Survivor benefits are not that lucrative, I suppose - because as a general rule, SSA doesn't mess with survivors that much. I found it much easier, and much quicker, just to learn enough of the law to hang in there myself (though it was neither easy, nor quick) than to try to find a lawyer to help. Most discussions with lawyers went something like this: Them: When did you become disabled? Me: I am not disabled. This is a SURVIVOR claim. Them: So what work limitations do you have? Me: I have no work limitations. This is a SURVIVOR claim. Them: Oh... okay.. so when did you stop working... Me: AAAAAAAGGGGGGGGGGGGGGGGGGGGGGGHHHHHHHHHHH!!!!!!!!
