mozartplayer Posted July 6, 2010 Share Posted July 6, 2010 I'm still waiting to see a copy of the three new questionnaires which the veteran's physician can complete to expedite processing of the claim if it involves one of the three new presumptive diseases; in my case, the hairy cell leukemia questionnaire for my claim which has been pending since 8/10/09, I also was treated for prostate cancer 8/1/05, but was diagnosed with hairy cell leukemia not long after that. Last I checked Reginfo.gov, the new AN54 reg adding the three new diseases had not gone to OMB for fiscal review yet and OMB can legally take up to 90 days for its review although I don't expect it to take that long. If the new reg did go to OMB, the status posted on Reginfo.gov did not get updated.I don't expect a decision on my claim before October, but hopefully, my leukemia will not require chemo before then even though I was diagnosed over three years ago. I'm lucky, for the time being. I'm assuming the three new questionnaires are in the process of being officially approved because the comment period on the Federal Register notice for them has expired. I doubt that the VA will send out any of the questionnaires for the veteran to give to the physician for completion before the new Reg adding the three new diseases is published in the Federal Register to make it official and that won't happen until after OMB completes its fiscal review. The bureaucracy moves very slowly even at full-speed. Hopefully, the new reg will get implemented despite Senator Webb's objections. I have to admit to being surprised by his reaction after he pushed through the post-9/11 GI Bill which has a 10 year projected cost much higher than the 10 year projected cost for paying benefits on claims for the three new diseases. http://www.reginfo.g...4&RIN=2900-AN54 Link to comment Share on other sites More sharing options...

Yes that is a good point and also the VA pays out more for malpractice settlements that these presumptives are projected to pay out.
