Married Vets Can Be Each Other's Dependents?

Question

While talking to my VSO this morning, he mentioned that I need to fill out the 21-686c that came with my decision letter. I told him that I wasn't sure I could do that since my daughter and I are already listed as my husband's dependents. Is he correct? I can claim my husband as my dependent, while he claims me?

I'm finally going to be able to really contribute to the household coffers in a meaningful way - I'm thrilled beyond words about that. But I'm unclear about dependency...

Can anyone clarify this?

Thanks!

I would think that you could only get compensation for dependents of one or the other, but not listed as each others-youd be getting it twice.

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)

That's what I thought, too. Seems like double-dipping to me.

I will clear this up for you. My wife and I are both disabled vets. She is 100% P&T. I am 70%. I am her dependent and have CHAMPVA and military ID Card. She is also my dependent. We have been married for over 35 years and served on active duty together. So the answer to your question is YES.

For CHAMPVA purposes, but are you both being comped at the Married with Spouse rate as well? SInce you are both supporting each other with the same money it seems be in disingenuous, regardless of whether or not its 'allowed'. If it's legit, so be it, but I have to wonder if that Reg. slipped by someone in the past.

Ive researched this a bit outside of hadit, and it seems that you each CAN claim each other. And each claim the kids.

It is legal and it is allowed. I specifically asked the VA about that when they began paying me comp for my wife. They told me I was entitled to it.
