Tdiu Frustration

Question

Got the white envelope from the Columbia VA Regional Office. After waiting just over a year for the claim I get a big fat DENIED...again. I'm not sure if this is the second or third time, but what I do know is the last time I got a denial letter from them it took just over a month. I'm already strategizing my next move though. I may have to get an attorney, the last time I did that the attorney fell through, but his professional paperwork helped my SC claim go from 50% to 70%. It is sooo FRUSTRATING to have to wait that length of time for a denial!!! Does anyone know of any good veterans' lawyers in or around the Columbia, SC area that can help me with this?!

Berta (and others),

Here is my TDIU denial letter. If you see anything within it or have any advice that can help me I would greatly appreciate it. Thank you.

They are saying none or all of these SCs are causing you inability to work-

Do you get SSDI?

If so,is it solely for one or more of the SC disabilities?

Are you able to afford a strong IMO that can show these SCs render you unemployable?

Has VA Voc Rehab ever turned you down solely to your SC?

If so -that is evidence they need.

Did they list and refer to all of your evidence in this decision?

They are saying that your SSDI does not establish 'adequate' reason for award.

Are you able to afford a strong IMO that can show these SCs render you unemployable?

Has VA Voc Rehab ever turned you down solely to your SC?

If so -that is evidence they need.

Did they list and refer to all of your evidence in this decision?

When a vet gets SSDI for both VA and non VA reasons, then it can often be necessary for an IMO doctor to state how the SC disabilities render the veteran unemployable.

Is the non SC part of the SSDI award something that could possibly be claimed as due to service?

I agree with Pete to never give up.

And as a claimant myself I know the frustrations of many denials.

VA has made it clear that the SSDI records dont support a TDIU award so ,in my opinion, you need to consider getting a strong IMO.

If any of the ratings seem too low, by all means appeal them with evidence that warrants the higher rating.
