For a 100% based on hospitalization, you have to me in the hospital for 21 days or more for a service connected condition per 38 CFR 4.29 http://www.benefits....PART4/S4_29.DOC . If this is a post-surgical convalescence claim (for a service connected condition), the criteria are in 38 CFR 4.30 http://www.benefits....PART4/S4_30.DOC . Some convalescent periods are specified in the Rating Schedule .... some are recommended by the surgeon. i was placed in the hospital in nov 2009, but my claim was not submitted until mar 2010. can i receive a 100% disability during my stay even though the claim had not been put in?
