New Clothing Allowance Request

Question

It says on the VA website that the order to request multiple clothing allowances, you must fill out the VA Form 21-8678 and a VA Form 21-4138. Two questions:

  1. Has anyone requested multiple clothing allowances this year, if so what did you write on the 4138?
  2. Is the multiple clothing allowance retroactive to the Sursely v. Peake?

I applied for the second clothing allowance. All you have to do is to identify the medical reason for the second clothing allowance.

It is not retroactive, it became effective this year.

But what would justify a second allowance? I would imagine any condition that creates excessive wear and tear on clothing, but would love to see a successful submission.

Examples:

A veterans wears an AFO due to drop foot ( wears out pant leg)

and the same veteran uses fore arm crutches to walk.. ( wears out shirt sleeve)

A veteran uses a prosthetic leg, which wears out pants leg, and uses wheelchair wearing out sleeves...

Sursely v Peake explains the law better than I can ......
