Thanks to anyone who replies-

How would this be awarded percentage wise?

30 % IHD SC

30% PTSD SC

10% HBP 1151 as if SC.

to clarify- the HBP 1151 was due to medication errors and not associated with the veteran's IHD. Yet.

Now to check the Comp rates in 1988.

I think I got snookered!!!!

They paid the retro as 50%.

One more question- I didnt post this correctly-so I still might not be getting this right----

The HBP isnt an issue yet and I might file CUE on it- but might not----

It was rated at 10% in 1988 NSC then became part of the FTCA /1151 case was never paid under 1151.VACO OGC report clearly states the medication error caused the HBP and contributed to my husband's death.

Are you saying the 30% PTSD and the 30% IHD come to the 60%

even if I overlook any potential HBP SC rating?

I think I got it-

the 30 for IHD and 30 for PTSD plus 10 for HBP would equal the 60%

But I would need to CUE a 1998 decision for the HBP to be added.It was rated but never paid.

This was the same decision that had 3 prior CUEs in it.

The only evidence they used was the VA Central report that mentioned the HBP contraindicated by another VA med, contributing to the veteran's death.

I mentioned it to NVLSP in my review request about the EED.

But I would HATE to deal with Buffalo RO again.

I will see what NVLSP says.

I have a calculator that exactly mimics 38 CFR, section 4.25, Table 1, including bilaterals. It works with Microsoft Exel. If you like, I can post it for you to copy. It also has Table 1 beside it so you can double check.

Others sure might need the Excel spreadsheet if they have multiple SCs.

Attached is the Microsoft Excel calculator I use. Ihave used it for three years now and have found it to be totally accurate for bilateral and individual disabilities rating calculations. It figures bilaterals correctly and transfers that percentage (if any) to the individuals column. It also has the 38 CFR 4.25 Table 1 beside it just in case you dont trust the calculator. Must have Microsoft Excel to use.
