Informal Claims And Inextricably Intertwined

Question # 1

If in 1978, a vet had an Audiology C&P, requested by a VARO adjudicator and

listed as "Special Ear Examination" -- and the C&P examiner list's under findings

Tinnitus alledged -- would this be an official (if there is such a thing) informal claim ?

FYI - 20 something years later Otitis Media and Tinnitus were both granted. In

going over ALL records I've just realized that at the time of the Ear C&P, I was

taking VA Rx'ed antibiotics for Otitis Media and this is why the ear canal showed

no effusion.

Question # 2

Can anyone refer me to something in writing, concerning VA, that defines

Inextricably intertwined claims and/or issues. I have my own understanding of

this phrase but am really interested in learning more about VA's rulings on this.

Most good law libraries will have West's Veterans Reporter service. You can subscribe to it, as I must, but it's very expensive ... about $100 a volume, and there are 19 now. Or you can subscribe to it online, which is *really* expensive and I can't afford. But you may be able to order a set from GPO, since they will al fit on one CD. although you may have to put your own search engine on it,9 and they are listed by their case numbers .. not in Wet citation format.
