Rate this question

KDM

Question

In 2003 I was granted a zero percent service connectionfor an initial claim i apealed in a NOD and asked for an increase or an upgrade in 2003 withgin the years time limit.

I was granted an upgrade of in 2013 for the 2003 appeal/ upgrade.

This was on a CNP for the appeal that i was given in 2012 9 years later of April they say that is is new evidence I said then in 2004 that the evidence existed etc and so on

Thet only granted me back to April of 2012 so I appealed there descision for an EED and they Denied it usinga CUE,

This then went back to Washington where they looked at there denial and from whgat i understadn the bad EED date and Remanded the case baclk to the regional office to make another descion and look and develop this case is this in my favor or not?

A remand is better than a denial, not as good as an outright "award". What were the reasons and bases for the remand?? A remand essentially means "delay". And the VA loves to do that. Your remand will be delayed by the RO, and then you can finally appeal the implementation of the remand, which means more delay.

"and they Denied it usinga CUE,"

Do you mean the called a CUE on themselves within the 2013 decision?

I would echo Broncovet's question here as to the reasons and bases, and am curious how they stated the reason they cued themselves, unless I misunderstood that part.

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.
