Question

22 Yr USAF Veteran, AFSC 42353,Fuel Systems Mech,; I have an ongoing disability claim for peripheral neuropathy, symptoms are getting worse but cannot get an accurate diagnosis from the VA has been over 9 years of appeals etc... would appreciate any advise on how to proceed. Thanks and God Bless!

Hello Berta, Thank you for your comments and questions and to me it does not matter that your civilian I welcome any and all advice; you've asked several questions and I will attempt to answer them briefly

Total SC 80

Seizure Disorder with Neurocognitive defects 60%

Hypertension 10%

Gastroesophageal Reflux disease 10%

Hypothyroidism 10%

Rt Shoulder Bursitis 10%

Rt Ankle Tendinitis 10%

Where I went to school these numbers would add up to more than 80% but the VA must use a special kind of calculator. I have reactive Hypoglycemia but have never been diagnosed with any type diabetes although they test me for it each year. This answers a few of your questions and I'll address the others later to maintain brevity and minimize confusion. Thanks again for your advice! May God Bless You. Dan

I'm back again Berta, The law firm that represented me out of Rhode Island was compensated for their services. They filed a petition for fees with the US Court of Appeals for Veterans Claims under the Equal Access to Justice Act (EAJA). The Court ordered the VA to pay the fee to the law firm for their services in representing me as a veteran. On 4/15/2013 the the United States Court of Appeals for Veterans Claims found in my favor that the BVA had committed legal error; my case was sent back to them with instruction to correct the error. I don't believe they gave (the BVA) any deadline or consequences for taking too long in arriving at a decision and can offer no other explanation or details. I was instructed to contact my local DAV for assistance and their standard reply is and has always been the same " We haven't reviewed your file but our advice to you is just be patient and wait another year or so these things take time" I am a patient man but would like to know more of the process and if there is anything I can do to speed it along. Hello Bob K, No I've not contacted that office. Do they have more specific information about how my claim is going? I'd be happy with any news on where my claim is in the process. Thanks for the info but how do I contact this office? Thanks again for your help! Dan

Hi Dan,

Its a pinned item in vets claim research. It starts with 202 #.

My case was stuck in limbo for quite some time. I kept

getting different & wrong info with every inquiry. I called

the 202 # , talked to someone there & they called me back

in a couple of days. I explained my case & I had a C&P

within 2 weeks & claim closed 2 weeks after C&P.

It takes alot of tries to get through on the phone,

but you have to keep trying. I wish you the best of luck.

Hello Bob K, I have the case Mgmt Ph # you suggested will call in the a.m.; also have been doing a ton of belated very useful research on this website. I can see I've made quite a few tactical errors; mostly in believing that my claim was in good hands and being aggressively worked. I would also solicit advice on how to find another more reliable, caring and knowledgeable DAV representative, or suitable substitute. What is the process to fire (for lack of a better word) my current DAV rep and then appoint someone else? I would really like my claim to be handled by an entirely different office as I believe this one is either overburdened, unsympathetic or a combination of both.
