Inferred Claim Question

Hi all and good morning.

I looked at an old rating eval and noticed i was diagnosed with sciatica due to broad base collapse of L4-L5, L5-S1(SC). Should my sciatica have been an inferred claim secodary to back condition? If so can i request it be backdated to last eval? I dont really understand all of the language in my eval, but any opinion/suggestion would be greatly appreciated.

Is your claim still on appeal? If it is final then you must file a CUE claim to get it service connected and have any hope of getting it backdated to last eval. Why not scan your old rating decision to hadit so we can look at details of the rating. Leave of name, SSA# or clalim #. Getting retro for claims that should have been inferred is a major hurdle depending on exact wording of the rating and the evidence. You can always run it by a VA lawyer to see what he/she says. If there is a shot at mucho money they will probably take it for you.
