Game plan for C&P's

I feel like I have to have a strategy in place on hubby's claim now that we are getting down to the finish line. The C&P scheduler called us yesterday on a Saturday morning and Darnit we missed his call! Here's my plan with a counterpunch to every punch that VA might try to throw at us. At least the ones that I'm aware of...

1. Go to CNP exam. Take a type written single page of paper that hubby can hand to the doctor as well as keep a copy for himself. This will restate the symptoms he has already reported to VA as well as provide the answers to questions the doc would ask that affect the rating. These I will get by looking over the DBQ for the issues he has filed for. Also I will look over the clinicians guide for the issues he has filed for.

2. 3 to 5 days later go on my healthy vet and download the exams using the blue button notes feature. If the exams are favorable do nothing. If the exams are negative or say things that we didn't say, Then immediately go and pay for two IMEs. I already have two specialists that I have previously contacted ready and willing to do the IMEs. Immediately upload these IMEs to E benefits. Then the evidence would be two against one and if VA follows their own rules they would have to grant the claim.

3. Wait for the rating decision. If it is favorable do nothing. If it is not what we expected, Either the percentage granted or the effective date granted, Then review the reasons and bases section for any legal errors that VA made. If there are any, then use Bertas "go Cue yourself "template explaining to Va exactly the legal errors they made. If no response within one year then file NOD.

What other punches might VA try to throw at us that I haven't thought of here?

Do you really want to have this conversation?

If you are TRULY are in 9-10 level PAIN ALL THE TIME you wouldn't be able to type a coherant message. Sure looks like we have someone exagerating. If you are in 9-10 level pain all the time you wouldn't even be able to eat effectively.

Before you cast stones at others, you better take a good look at yourself, 9-10 level pain constantly, but can compose e-mails and communicate effectivey, sure looks like a fraud to me! Its people that exagerate their pain levels that really screw over vets who honestly try to assess their levels. Because when those tools calmly say in their doctors appointment my pain level is 9-10 and they have regular diction, resperation and a steady level heart beat, it causes providers to assume all vets are lying.

You also seem to think they give CPAPs out like candy, Here is a clue, you only get a CPAP assigned based on OBJECTIVE medical evidence. Reported pain levels that is a SUBJECTIVE data point. I suspect there are more people lying about pain levels than CPAPs assigned without objective medical evidence.

It is people lying about pain levels that caused me to have to sit down at a pain clinic with a VA psychologist who's obvious mission was to determine if I was lying and trying to get opiods. I nipped that in but really quick when I pointed out to the idiot that i was allergic to opiods, did he have any more questions??? He backed right off an moved on. My time wasted, because of people LYING about their pain levels.

I don't take opiod to many side effect but va will shove them on you and as far as pain what I said is just what

I tell my doctor all the time so what if you think I am lying you don't treat me and you ant no doctor

and you don't know me and I have no time for lying to you or anyone else I don't have to all they do is look at

my records and the scars and know there is no lying in my system it all in the records.I go to therapy 3 days

a week for the last year and a half next is pool therapy so I stay in treatment hot once a year all

year just so you know I have a cpap do I file a claim for it NO because I been snoring since I was

10 not SC at all or in no way

heck no VA didn't cause that already had this before my time in milatary

So you must have someone almost constantly helping you, you drive yourself to therapy with a constant pain level on 9-10?

Don't accuse others of gaming or lying when you have some obvious inconsistancies of your own!

Your telling Navy wife that she should send it all in and not set on it, she has sent it all in. If you actually read what she said, you would understand she was not sitting on IMO's but had doctors lined up to do them, IF the VA doctors started playing fast and loose with the facts.

Would you recommend a person with a TBI (and in this instance I believe it is causing cognative problems) trust the VA to "do the right thing" and not have someone advocate for them?

navywife, I apologize to you if you thought I am referring to you but it was not meant

to be I was told to send in all your info in on your claim all one time and don't worry about the

effective date all your ducks in a row that all I was saying wasn't try to call you a liar or

nothing like that. Just when you send in new info they have to re look at the claim again and that

take time for a quick claim to be done it needs all the fighting power an IMO OR IME records you have

VA plays dirty but evidence win .So you have to do whats need to be done to win.

I told you you ant my doctor and yes I drive to therapy and I drive every day every day I do what

I want to do or my pain let me do I know my limits and yes I Tell va that I have disabilities and I was a

jack of all trades before my injury I still work on my own cars I work on my own house why because I can I ant dead

I just have disabilities everything I once did I still can do but not as much and it takes a lot longer than it

use too. exercise relieves pain disabilities is what I have to live with but I ant dead.RU and she did say pay for an IMO after she get the exam report so look over post one again quit making a big thing out of nothing ok I through with this
