Game plan for C&P's

I feel like I have to have a strategy in place on hubby's claim now that we are getting down to the finish line. The C&P scheduler called us yesterday on a Saturday morning and Darnit we missed his call! Here's my plan with a counterpunch to every punch that VA might try to throw at us. At least the ones that I'm aware of...

1. Go to CNP exam. Take a type written single page of paper that hubby can hand to the doctor as well as keep a copy for himself. This will restate the symptoms he has already reported to VA as well as provide the answers to questions the doc would ask that affect the rating. These I will get by looking over the DBQ for the issues he has filed for. Also I will look over the clinicians guide for the issues he has filed for.

2. 3 to 5 days later go on my healthy vet and download the exams using the blue button notes feature. If the exams are favorable do nothing. If the exams are negative or say things that we didn't say, Then immediately go and pay for two IMEs. I already have two specialists that I have previously contacted ready and willing to do the IMEs. Immediately upload these IMEs to E benefits. Then the evidence would be two against one and if VA follows their own rules they would have to grant the claim.

3. Wait for the rating decision. If it is favorable do nothing. If it is not what we expected, Either the percentage granted or the effective date granted, Then review the reasons and bases section for any legal errors that VA made. If there are any, then use Bertas "go Cue yourself "template explaining to Va exactly the legal errors they made. If no response within one year then file NOD.

What other punches might VA try to throw at us that I haven't thought of here?

why would you have to have a game plan for a C&P exam? I always thought just be honest

you got to have a plan somebody not telling the truth or what. Why would you wait to send in

IMO'S or IME they should already be in then you wont have to appeal turn in everything you got

at the start it will be a lot easier JMHO. RU

Oh, RU, how many of us felt like you at the beginning of a lengthy battle with denials, appeals, descent into poverty and despair etc.

If the VA could be trusted to fairly rate veterans who are just honest, this forum wouldn't exist and scores of vets who offed themselves rather than continue the fight would still be alive.

No one is suggesting dishonesty or gaming the system; people have just learned how anything can be skewed for denial so the idea is to be sure that details of your worst times are shared to maybe cut down on some waiting and grief.

And I'm not getting down on you - just want to clarify.

And if you think people are not gaming the system I will sell you a lake on the moon you have people

filling for a mosquito bite that happen 10 years ago just saying. another thing is evidence win claims

no evidence no claim

A quote like "Make sure he does not shower, were Cologne or do his hair, if he has any, LOL!" sure looks like an attempt to game except for the LOL, which would appear to replace the eye wink in face to face communication.

As for having a plan, having a plan isn't gaming the system. Knowing what you are going to do if the VA trys to cheat you is just smart!

I personally wouldn't suggest the written note of symptoms and such, but I also realize since I do not, I will forget to discuss things at the doctors appointments. Having to write it down could be used as a peice of evidence to suggest an inability to manage ones affairs. I think I am going to start journaling my medical observations/measurements and just turn them over, an argument can be made that the journaling is the best way for a provider/clinician to see observable patterns without "submitting a statement". As long as a person is turning in an honest journal that is consistantly recorded I think it is an honest middle ground. Clearly that is not a viable strategy for this go-around for you!

I commend you for your advocacy on behalf of your husband! It looks like a good plan.

That's why a lot of the back log is coming from false claims that have to be

look at by va employees who should be working real claims. I see some people

got 40 disabilities listed as service connected hell a man with that many

disabilities had to be on sick call everyday no time to fight war you be to sick

ITS just like telling a man who was planning to retire to go to doctor tell him you are

not sleeping well get a cpap machine and buddy statements hey you get 50% I call that

gaming but that's just my opion. Everything that go wrong after service is not

always service connected. You keep your journal and tell me when it does you any good

with your claim. VA could care less what you write in your book unless you are a doctor

I don't need a book to tell how I am feeling its pain at 9-10 all the time,depress all

the time and mad as hell with VA. If I had evidence I know that could win a claim I

would send it in with the claim and not after a decision of a denial that's adding

time to your claim and its already long enough as is

Do you really want to have this conversation?

If you are TRULY are in 9-10 level PAIN ALL THE TIME you wouldn't be able to type a coherant message. Sure looks like we have someone exagerating. If you are in 9-10 level pain all the time you wouldn't even be able to eat effectively.

Before you cast stones at others, you better take a good look at yourself, 9-10 level pain constantly, but can compose e-mails and communicate effectivey, sure looks like a fraud to me! Its people that exagerate their pain levels that really screw over vets who honestly try to assess their levels. Because when those tools calmly say in their doctors appointment my pain level is 9-10 and they have regular diction, resperation and a steady level heart beat, it causes providers to assume all vets are lying.

You also seem to think they give CPAPs out like candy, Here is a clue, you only get a CPAP assigned based on OBJECTIVE medical evidence. Reported pain levels that is a SUBJECTIVE data point. I suspect there are more people lying about pain levels than CPAPs assigned without objective medical evidence.

It is people lying about pain levels that caused me to have to sit down at a pain clinic with a VA psychologist who's obvious mission was to determine if I was lying and trying to get opiods. I nipped that in but really quick when I pointed out to the idiot that i was allergic to opiods, did he have any more questions??? He backed right off an moved on. My time wasted, because of people LYING about their pain levels.
