Its a mystery to me that the VA could say everything is fine after a stress test 7 months ago and after a stress test thursday the Doc is scheduling me for an emergency angioplasty.

I will never again step foot in a VA Medical Center.

Is there any direct connection of your problems to your service?

I suggest that you file a Section 1151 claim and even a SF 95 if you want to sue them-

If the VA has caused a veteran additional disability due to medical error the veteran can be compensated for it by additional compensation . And the VA can be sued.

"Learned that I got CHF and sub-clinical COPD

So far I've had 9 caths and they have placed three stents. One of those

stent caths went bad and they nicked the nerve bundles...that caused

PN which is now in both legs. Just three weeks ago I was told that I

now have demylinating neuropathy and it was suggested that perhaps

the heart meds that the va provided worked against my metabolisum

causing the new problem. The VA neurologist said that the damage

has been done and it's irreversable. I can slow down it's advance by

taking a vitamin but that they best they have to offer."

Probably B 12- did the VA "Nick the nerve bundle" ?

If the VA did that and also you said the meds they gave you were wrong-if you can prove that you have basis for Sec 1151 claim.

Also You have plenty of time (the Statute of limits is two years after finding that medical error occurred)

to file a SF 95 -I will attach as this is first step in filing suit against them.You send this form to the VARO regional counsel that covers the VAMCs that committed these errors.

Ask for millions in the damage amount and make sure you total and repeat this amount where it says Total.

I suggest that you get an independent medical opinion to help this claim but to me- it is prime facie-

I see evidence of medical malpractice here.

Who suggested that the heart meds could have caused the "new problem" and can you tell us what the new problem was that they were talking about?

DId they write this in your med records?

DO you have diabetes and are you an incountry Vietnam veteran?

List as witnesses on the SF 95-any VA doctor who you believe buggered your care-

For the Section 1151 claim I suggest that -based on what you stated here- you send them a letter (with your c file number on it)saying

This is a claim under Section 1151. I believe my VA medical records and private records will reveal that I have suffered additional disability due to VA health care.

Tell them just about what you said here and attach any copies you can of the recent findings at the private hosp and also a copy of what the VA doctor said (hope it is in your med recs) as to the potential heart meds

causing a new problem (I am assuming the meds were VA meds)anfd tell them how the VA surgery (I am assuming this was done by VA) buggered up your nerves and caused this PN situation.

Also claim the PTSD too and if I were you I would file the TDIU form also with this claim. I posted it as attachment here today andit can be found at hadit in a search.

Many vets pursue Sec 1151 without sueing VA-this avoids an offset to their comp.

As long as the VA compensates you for their medical errors-that is the important factor to consider.

I am a Section 1151 recepient and I also sued them -twice---- based only on what you have stated -in my opinion- you have a good reason to file these claims.If VA committed these medical errors.

Still -I suggest that a claim like this can often only be won with a good Independent medical opinion.

If you posed that question to a real doctor for an independent medical opinion-

I wonder what a real cardio doctor would say.

They dont even know how to calibrate the HBIAC test equipment- I wonder how many diabetic vets get a false HBIAC reading and it is low so they never get a diabetes diagnosis but could have diabetes.

The vitamin that I was told to take is

"Alpha Lipoic Acid" 200-600 mg's per day

has been shown to help injured nerves

regenerate their insulation.

The new problem is the Demylinating

Neuropath that has just been diagnosed.

The caths were done at two local

hospitals, some were done at the VA's

instruction. Nobody can say when and where

the damage was done...just that it exists.

I hear opinions from various doctor's all

too frequently, none like to put those things

to paper.

NSC is not much money but it's better

than nothing.

I am of the opinion that the major

part of my issues started from the

PTSD that has been there all these

years causing problems at home and work.

It's only after several failed relationships and

lots of different jobs that somebody other that just

me started to see that I had a big problem

with the world around me. anger, stress...la la la

No I wasn't in-country or exposed to AO.

I was in the Coast Guard and exposed to a

different type of fire... some people do almost

anything to avoid going to jail...

My most recent s/c claim started in Jan 04

for an aquired anxiety disorder to include PTSD

and cardiac issues secondary to that. It made it

to the BOA but since the RO didn't provide the SSA

paperwork and my award of SSI that I can't get

cause the VA pays "TOO MUCH".or any of the records

from the Vet center that has been treating me for 9 months

my file is headed back on a remand...

Do you feel comfortable giving us the docket and citation number for the Remand?

BVA claims are public info-on the interent at the BVA web site ---no names, no c file numbers-maybe we could see something in the Remand that would help
