Compensation And Pension

A letter from VA says the "under VA law, compensation and pension can not be paid at the same time". However, I can not find this regulation. Is it made up?? Please post the regualtion if you can find it.

I think I read some where in the FBV book ( Federal Benefits Book)

Under protected pension

AS Long as a veteran beneficiary's income remains within established limits, or net worth does not bar payment, and the beneficiary does not lose any dependents.

& as long as veteran is rated P&T

However they have a new improved veterans pension but I don't think that applies here its for Housebound or nursing home veterans and veterans with no dependents.

I just filed a compensation claim and pension claim for a Vietnam vet. I filed both because he is eligible for both but not at the same time. It is my understanding that the approval for pension is normally faster than the compensation. In this case he could begin receiving pension before his compensation is even completed. Once they complete his claim he would then only receive whichever pays out the most. Not both. Again, this is my understanding. Hope this helps some. I will send a link when I get on my computer.
