I suggest you read the DIC Motorcycle accident member posts  here

as well as other pertinent DIC info in the DIC forum and get up to speed on DIC , now, in your lifetime.........as pass on what you learn to the spouse.....

I will again post the substitution regulations in our DIC forum...

Those of you who started death files ( I did some radio shows on it) need to put those regulations in there.

Your spouse , when you are gone will need to have them.

The spouse might even have to give them to their vet rep.

I bet if vet reps had to take a brief  test on what these regulations mean and the fact that a 21-534 should trigger this type of claim,

most of them would fail the test.

They regard any claims pending if you die.

They give the surviving spouse the same opportunity as the old accrued regulations did, but should reduce the time those claim take significantly.

Even if a spouse is denied DIC , they could still have a potential accrued benefits award,if they prove the veteran's rating at time of death, and all established medical evidence, would warrant the higher rating.

However the 21-534 must be filed within one year after the veteran dies  and any further forms VA needs must also be filed asap after the 21-534 is received..
