Leroy-if you send them new evidence within 90 days of the transfer they could possibly remand the claim-

then again- it always helps to send in anything at all that will help- as long as you can-

your claim might be there for 2 years before you hear from them-

Send it to the BVA as well as a copy to the VARO.

It used to be that when a claim went to the BVA and the vet sent new and material evidence into the VARO- they could often get a VARO decision and the appeal would be withdrawn.

These days it says on the I-9 to send anything new to the BVA instead of the VARO.

Yes you should send the information directly to the BVA.

If you don't want it going back to the RO for them to look over the info.

you must also submit a dated and signed RO Waiver form ! !

Very important not to forget this.

Thank you for your quick replies I have another IMO to add to my claim it is still being written and I am running out of time to respond to their request for me to do something thought if the new IMO was not done in time I would just allow them to send it to the BVA level and then send in the info when I receive it

How soon after filing form 9 does your folder leave the RO & go to D.C.?

If there is no hearing reqested does it get sent right away?

Or do they waiting until it is close to time for the BVA to look at it?

Do they send you a notice?
