Disability Retro-Pay

Question

Any and All.....

I have a question and can't seem to get a solid answer from the usual sources.....

I have a 90% rating and received my first monthly installment (finally) on October 1st.  expected, I was due some retro-pay.  (Retirement date: 30APR18; Claim filed prior to retirement date; effective date of my disability claim: 01MAY18).  The problem is that we received a retro payment of ONLY 3 months -- our calculations (going back to the effective date) is for FOUR months....?  Why are we not getting that 4th month?  Will we?  If so, when?  NOTE:  We did see that one month was listed as ' Being Withheld' as per our award letter....could this be the discrepancy?  Either way, we are thinking we are short a month.....Any help is appreciated!!

This might have been answered previously; I am having a bit of a problem maneuvering here.

If you have a regular retirement (i.e., 20 yrs AD), your retirement date was 1 May, not 30 April.   All regular retirements occur on the first of a certain month.  The previous day is the last day of AD.

Month After Law

Ref: https://www.law.cornell.edu/uscode/text/38/5111

"... payment of monetary benefits based on an award or an increased award of compensation, dependency and indemnity compensation, or pension may not be made to an individual for any period before the first day of the calendar month following the month in which the award or increased award became effective as provided under section 5110 of this title or such other provision of law."

The first month for which you would have accrued VA comp was 1-30 June 2018.

The VA electronically notifies the DFAS of all awards made to retirees.   The VA does not make CRDP determinations for the DFAS.   As indicated above, CRSC involves an application to one's service.   CRDP paid by DFAS is automatic EXCEPT for Chapter 61 retirees who also qualify for a reserve retirement upon reaching the age requirement.   They must submit a packet through their human resources command (who alerts DFAS of potential CRDP entitlement).   The DFAS does not keep a future suspense item to start CRDP for reservists yet to reach retirement age.

The DFAS Customer service # is here:

https://www.dfas.mil/retiredmilitary/disability/payment.html

The month ' Being Withheld' seems to indicate the VA is aware of that month.

Maybe IRIS could help more then DFAS, as this is a VARO award.

https://www.va.gov/landing2_contact.htm

Click on the  Contact Us thing, on the link above ,  then click on Ask a Question,

then fill out the info stuff and then tell them what VARO this is and what your question is, as to the withheld month.

It might take a week or more to here from them but I am sure they will provide an answer.
