0 HadIt.com Elder Buck52 Posted July 31, 2019 HadIt.com Elder Share Posted July 31, 2019 (edited) Well just my opinion If you can tell us why you were denied will help. other wise They are reviewing your records to set up a Date and Time/Location with the DRO at your R.O. or other location/or tela-conf if you are immobile? You should get a letter from your VSO or the DRO him/herself as to what you need as for as new and relevant evidence (New IMO/IME) from a qualified Dr to give his medical opinion about your condition or what your claiming that is in your favor. ...buddy letters ect,,ect,, You will need some medical records that show your condition is military related and just how bad the condition is rather it's a injury or a diesease. All current items denied are secondary to sleep apnea, info supplied was nexus letter IMO from the same Dr. for sleep apnea listing all items claimed as secondary with explanations for ea. specialist in sleep medicine PHD. from Harvard with over 30 yrs. experience. also setup the first sleep testing center in Calif. for military personnel, astronauts, fighter pilots, etc. these secondary items were all submitted after BVA approval for sleep apnea as secondary, sent to VES for several C & P's Once denied, I requested DRO Review in April, in July I received a call from Minn. office saying I requested a call when sent in DRO request my claim was originally sent to Phila., then I received a letter from VES for review records only. UNLESS IT WA SIN THE LETTER YOU RECEIVED? Try calling the 1-800 # ask them to check on this for you or check with ebenefits if you have that on your computer? You should also check on My HealthEvet progress notes or '' notes'' and see what all is in those. if you use a Certified VSO or claims agent ask them to check on the VBMS for you. On that letter that the NP sent you reviewing your c&p and checking these medical documents from the sleep specialist with the P.H.D. From Harvard U and has 30 years experience This NP should have gave you a Phone # or email letting you know how to get in touch with him/her? if they did then call them and request they look at the sleep specialist notes that was obviously over looked during the last C&P. I hope you have requested your complete/Copied over to a Redacted C-File? on CD? 0 HadIt.com Elder Buck52 Posted July 31, 2019 HadIt.com Elder Share Posted July 31, 2019 It seems you have the right type of evidence coming from a Sleep Specialist PHD in sleep medicine ..so your Dr has the correct credentials & 30 years experience they don't get any better than that..AND HE /SHE OPINE IN YOUR FAVOR if you submitted these medical documents and all secondary conditions to your now service connected Sleep Apnea and these records are in the C&P Report and they neglected these medical records ..> you have reasons to file a CUE Claim.. I only have the secondary sleep apnea items pending at this time and the paperwork does not state want they are reviewing the records for.
