navydoc2
I wear the metal hinged braces on both kness and appliedd for SMC, but was denied because they are four years old. Can I appeal this decision, or just get new braces and reapply next year. Thanks.

navydoc2
You need to tell us what is the reason for the denial That was the reason for the denial that I have not replaced them in four years. I had not applied for SMC because I did not know I was eligible.
HadIt.com Elder john999 Posted September 13, 2009 HadIt.com Elder Share Posted September 13, 2009 Yes, you can appeal any denial of benefits. Get some new braces if that is the reason they denied you. I think their may be other reasons. They are just throwing out the old braces as a red herring. I know the VA has very specific regs on loss of use for SMC.

They said they included an appeal form but there was not one in there.denial_ltr.rtf
